Fundamental values like racial equality or environmental justice would be protected not by law that stands apart from politics but — as they typically are — by ordinary expressions of popular will.
Really? So if the non-black majority in the country decides to re-institute black slavery, it's OK? That would be the popular will, right? "Democracy"?
Unbelievable ignorance in the guise of academia. Minority rights are safe only where they are guaranteed by laws superior to that of the current administration - if there aren't any of those, they're up for grabs every time the government changes.
No Constitution, no country. Build a new, Woke, urban one based on progressive fantasies and expect everyone to fall in line? Not happening.

It wasn’t that long ago that the enemies of Freedom tried to hide their hatred for America and it’s Constitutional Republic. It’s interesting that the “Paper of Record” now spews Marx like nobody is watching.
I agree with the headline.
The constitution is not a list of rules for us. It’s a list of rules for the government, which is run by us.
That government breaks every law in the constitution.
But they aren’t. We never took control and put them all behind bars.
So yes, broken it is.
Does that mean people should just stop by and take their crap in the name of equality and justice? Since the Constitution is so wrong, we can just make up whatever rules we wish to live by now, right?!?

I found hilarious the mention in the op-ed of liberal goals of reforming the court system and putting power back into the hands of elected officials, when THEY are the ones who run screaming to courts to block legislation they don’t like.
Further, it was Trump who essentially remade the courts across the federal judiciary and the SCOTUS who put that power back into the hands of elected officials through the overturning of Roe v. Wade.
Sedition, plain and simple.
Overthrow the Republic, however mangled and replace it with pure democracy, temporary 50+1 majorities and screw minority rights, constitutionalism and the rule of law.
A call for civil war.
Bring it.
Better now when I can still participate than in my dotage when the best I can hope for is to get one or two of them before going down.
These two law professors prove the adage about education not making someone smart, wise, or moral because these two are none of the above.
