That is kind of a gray area. If the AFT agent was violating a state law, then, yes, the sheriff could definitely arrest the agent. But I am sure that the agent would lie and say that they aren’t taking the pics with the intention of putting them in a database. (Pictures that will not be converted to text and entered into a database are not illegal.)

If those photos are stored “In the Cloud”, then that would be transmission of personal information. Would that not be a felony?
