Lois Lerner was not on trial in a court of law at the time. Moreover, there is no legal code to prohibit using either the IRS or the FBI as partisan tools.

I had a lawyer tell me that in my state, a corporate officer or director who asserts his Fifth Amendment rights in a case where the corporation is a party to the proceedings is immediately disqualified from holding any fiduciary position in the company. The reason for this is obvious: a person in this position is effectively stating that he or she has a conflict of interest in the proceedings.
It would probably not be a bad thing for such a rule to be in place for all government officials who aren’t elected to their positions.
