A pregnant Texas woman said her unborn baby should count as a second passenger in her vehicle after she received a ticket, citing Texas' penal code in the wake of Roe v. Wade's being overturned.
Brandy Bottone, 32, of Plano, was pulled over while driving in an HOV lane. Bottone was stopped by the Dallas County Sheriff's Department, which was looking for drivers violating the HOV rules requiring drivers to have at least one passenger when using the lane.
When a sheriff's deputy told Bottone about the rule, she said she did, in fact, have a second occupant in her car — her unborn baby.
"I pointed to my stomach and said, ‘My baby girl is right here. She is a person,'" Bottone said.
The officer responded the rule applies to "two people outside of the body."
Bottone, 34 weeks pregnant at the time, told the officers with the overturning of Roe v. Wade her unborn child now was recognized as a living person.
'And then I said, ‘Well [I’m] not trying to throw a political mix here, but with everything going on, this counts as a baby,'" Bottone told NBC.
Bottone told The Morning News that the officer told her he didn't "want to deal with this" and insisted that the law for HOV lanes required there to be "two persons outside of the body."
Deputies told Bottone if she fought the ticket, it would likely be dismissed. She plans to fight the $215 ticket.
"This has my blood boiling. How could this be fair? According to the new law, this is a life," Bottone told The Morning News. "I know this may fall on deaf ears, but as a woman, this was shocking."

Brandy Bottone
Is she wrong?
[Certainly NOT guilty.]
Bigger question would be a car seat with a baby?
Not guilty. But yes sounds good
Will Abbot prosecute her?
The baby has the best car seat available under the circumstances.
She has a point. But it may be on top of her head. And legislatures will need to adjust the wording so that what used to be implicit knowledge among the sane populace, will now be explicit for those who hid behind the door when the implicit knowledge was being given out.
Baby on board!
BRILLIANT!
Touché!
Inspired by all those criminal cases where the perp was charged with 2 counts of murder for killing a pregnant woman.
“According to the new law, this is a life,”
Well, Dobbs or no Dobbs, it’s a life, honey.
Personally, I don’t a problem with an unborn counting toward “car pool” status.
‘Bigger question would be a car seat with a baby?’
Texas law requires children under eight be in a child safety seat.
She’s gonna need a car seat soon anyway.
Why not get one now and put a baby doll in it until the big event?
That law doesn’t cover negative numbers?
Seems reasonable to me.
I have no problem at all with that assertion.
As far as car seats go, the baby is in the best car seat imaginable.
A for effort.

‘That law doesn’t cover negative numbers?’
Under age 8 which would include pre-born children.
Because the law was written with, or you can construe a loop hole doesn’t mean your blood should boil or you should be shocked as a woman. You’re sick and obnoxious.
If they try to prosecute her and she keeps appealling, it will end Abortion in America (5 judges will say its a person).
She is one smart cookie.
Besides, a $275 fine for an HOV violation with 100,000 Illegals driving around Texas with fake plates and no insurance, (and kids standing in the seats), that cop can bite me.
Defund the police.
I’d count two people under one condition: she isn’t having twins.
