New Hampshire Snowmobile Carry Ban Repealed

U.S.A.-(AmmoLand.com)- HB 1636, removing the antiquated ban on carrying loaded pistols on Off-Highway Recreational Vehicles (OHRV) and snowmobiles, has become law in New Hampshire. Governor Sununu signed the bill on Friday, 17 June 2022.

House Bill 1636 is a simple stand-alone bill that removes the current ban. From HB 1636:

1  Off Highway Recreational Vehicles; Loaded Firearms Prohibited.  Amend RSA 215-A:20 to read as follows:


215-A:20  Loaded Firearms Forbidden.  No person shall carry on an OHRV,
or a trailer towed by same, any firearms unless said firearm is
unloaded.  This section shall not apply to law enforcement officers
carrying firearms in the course of duty or to pistols
or revolvers carried [under a permit issued pursuant to the authority of RSA 159] by any person who is not prohibited from possessing a firearm by a New Hampshire statute.

2  Snowmobiles; Loaded Firearms Forbidden.  Amend RSA 215-C:35 to read as follows:


215-C:35  Loaded Firearms Forbidden.  No person shall carry on a
snowmobile, or a trailer towed by same, any firearms unless said firearm
is unloaded.  This section shall not apply to law enforcement officers
carrying firearms in the course of duty or to pistols
or revolvers carried [under a permit issued pursuant to the authority of RSA 159] by any person who is not prohibited from possessing a firearm by a New Hampshire statute.

3  Effective Date.  This act shall take effect upon its passage.

HR 1636 is the last in a six-year quest to remove the New Hampshire antiquated firearms ban.  Constitutional Carry passed in New Hampshire in 2017.

Was there any purpose other than to ban carry? Was there a reason for it in the first place?

You would think the ban would automatically become null and void after CONSTITUTIONAL Carry was enacted.

Oh great, now the trails will be knee deep in Animal carcasses, and injured snowmobilers wit self inflicted accidental wounds

Don’t you remeber the days when snomobilers were running g arohnd burning looting and murdering while armed? Why they were the most dangerous domestic terrorist threat to the us ever. Some trails were so clogged with empty shell casings that navigating them was near Impossible.

I heard there was an accident where someone riding a snowmobile was shot, decades ago.

I have not been able to verify the account.

My guess was the ban was intended to avoid accidental discharges, or reduce poaching.

This is a clean-up bill to eliminate the ban on carrying a loaded handgun without a permit on a snowmobile or ATV in New Hampshire.

This law was a leftover from the time prior to constitutional concealed carry in NH where it was generally illegal to carry loaded firearms in vehicles without a pistol permit. Open carry has been legal for a long time, but there were confusing and arcane distinctions like carrying in a parking lot vs. having a pistol in a vehicle.

Some of the restrictions on carrying loaded weapons in activities related to hunting seem to have come out of safety concerns from long ago.

This is an important improvement in the law.
