Derek Chauvin gets 20 more years in prison

Former Minneapolis police officer Derek Chauvin has been sentenced to more than 20 years on federal charges in George Floyd's killing. He is already jailed on state murder charges.

I can’t understand why nobody hasn’t challenged these actions of double-jeopardy as unconstitutional.


I believe it has been challenged and courts (SCOTUS?) have ruled the ban on double-jeopardy only applies to each ‘sovereign’ entity, the states being one and the Feds being the other. So states can’t subject you to double jeopardy and the Feds can’t either. But each can charge you with a crime for the same action.

So MN charged him with St. Floyd’s murder and the Feds charged him with depriving St. Floyd of his rights. Not saying it’s right, but that is how the law stands as of now.

56. If Chauvin was aware that Floyd was on Fentanyl, he should have immediately called for medical assistance AND NOT put his knee anywhere near the preps neck blood sins-arteries. Also he had fellow officers there to help him and he wouldn’t/didn’t use them. If he had, our country would not have burned and scores of police officers being killed.

I understand the distinction between State and Federal Charges, but that changes NOTHING, here.

We will never know the future crimes that Floyd would have committed. What we do know is at the time of his death, he had a rap sheet already a mile long. However he died, the crime spree would have certainly continued had he lived. Chauvn rots in jail but there are a lot of people out there that are better off for Floyd's death.

The original complaint, I believe, stated that Floyd was "wasted" and was barely coherent. It was part of the reason why the clerk was intimidated to accept money that he immediately spotted as being counterfeit. He thought that if he didn't, Floyd would turn violent.

So I'll step back, slightly, from my original statement. A skilled prosecutor, with the right judge and jury, could indeed cross the "beyond a reasonable doubt" threshold.

But I still say that the process was grossly unfair. Every state official and every news outlet, including Fox News, was foaming at the mouth for Chauvin to charged and convicted of nothing less than murder. The entire process, including the judge and probably the jury, was rife with hysteria and intimidation.

No time to research this at the moment...

I believe Chauvin pleaded guilty to the federal charge in exchange for state-federal concurrent time served.

Also, will this get him transferred to a federal prison?

That might be an improvement over Minnesota prison.

In fact, there is a large federal prison just outside of Rochester, MN.

A scapegoat. All the “sins” of the country have been heaped on him and he is condemned for them.
It’s to “prove” that most of the country is racist, and to pave the way for reparations.

Meanwhile, mohammed noor who murdered an innocent blonde woman from a country officially designated as “oppressor” got a few months.

There is no justice.

Double jeopardy only applies to being tried twice for the same charges. This federal trial was a civil rights charge.
