Florida's 15-week abortion ban remains in effect despite judge's order

CNN)Florida's law banning abortions at 15 weeks will remain in effect after the state filed an appeal Tuesday that stayed a state judge's order temporarily blocking the ban. In a verbal ruling last week, Second Judicial Circuit Court Judge John Cooper said that the Florida law was unconstitutional and that he would issue a temporary statewide injunction in a challenge brought by some Florida abortion providers. The law, known as House Bill 5, went into effect on Friday. Cooper signed the written order on Tuesday morning. But soon after, Florida Attorney General Ashley Moody, a Republican, filed an appeal on behalf of the state, automatically staying the judge's order under Florida state law.

Plaintiffs said they intend to file a motion seeking to reinstate the injunction.

Republican Gov. Ron DeSantis signed the new abortion restrictions into law in April.

Florida previously allowed abortion through the second trimester of a pregnancy, with exceptions to save the pregnant woman's life or avert "serious risk of imminent substantial and irreversible physical impairment" to the woman." HB 5 bans abortion after 15 weeks, with an exemption for a fatal fetal abnormality if two physicians confirm the diagnosis in writing. It does not allow exemptions for rape, incest or human trafficking.

Several abortion providers sued to block the law on June 1, arguing that it "criminalizes pre-viability abortions in direct violation of Floridians' fundamental privacy rights guaranteed by the Florida Constitution."

The judge is in the liberal stronghold of Leon County. His ruling will be overturned in a week or two. Another judge a few weeks back in Leon County had blocked FL redistricting, going into a woke rant about historical racism, etc. That ruling lasted a week or two, the FL Court of Appeals stated in no uncertain terms that the judge was wrong to issue the stay. This is just a liberal judge trying to get his name in the press.

If we can get a law that saves some babies, but can’t get a law that saves all babies, I’m in favor of saving some babies.

More importantly than getting any legislation, we need to persuade our fellow citizens that killing babies is wrong and should not be done.

Florida Attorney General Ashley Moody, a Republican, filed an appeal

Typical CNN. How comes they didn't say "Second Judicial Circuit Court Judge John Cooper, a Democrat, said"? The man is a lifelong registered Democrat, but in CNN parlance that just means he's impartial so no need to mention his party affiliation. No wonder they have no relevance, and their ratings are so poor. The MSM's level of hypocrisy is amazing.

I am so sick of this abortion stuff. If a woman cannot decide in 15 weeks that she does not want to have a baby, too darn bad. That is plenty of time to decide. Good lord these people are such drama queens.

The 15 week ban was a good move when Roe existed. We are in a different world now.

A bunch of states are about to put Florida to shame when it comes to protecting babies. Time to catch up.

You can see where this is going: Now that the Supreme Court reversed the ludicrous notion that the U.S. Constitution included a right to abortion via “privacy rights”, the Leftists will just shift to the state level and try to make the same claim based upon state constitutions.

Ahhh, still using that old “right to privacy” law claim used in the original USSC case I see.

They always seem to stumble over the “life” part of “life, liberty, and the pursuit of happiness” phrase and insist privacy is in there someplace they just know it is.
