“I’m sure Xiden’s puppet masters will pick a suitably-Marxist nominee, who’ll then be crammed through the Senate confirmation process in record time.”

I am 100% sure Ketanji Brown Jackson will be approved by a 53-47 vote on April 7, 2022.

Judge Jumanji will then compete with Sotominor for dumbest justice

Good riddance!

But his successor is probably worse.

He must feel like a worthless loser to be pushed aside and stomped on by Biden and his fanatics.

If Breyer had not resigned (and say died under the next President) would the confirmation still be valid?

I would think not as a succeeding president can not be bound by a prior president’s nomination when the nominee is not sworn in.

So, there will now be five men, three women, and one undetermined justices on the Supreme Court.

His successor has already been appointed and confirmed - Kentanji Brown Jackson. I assume she will be sworn in at time of Breyer’s resignation becoming effective.

Yes it is a first, and unconstitutional in my opinion, since the Senate confirmed a nominee for a position that wasn't vacant at the time of confirmation.

Where does the Constitution prohibit that? It just says the president will nominate and, with the advice and consent of the Senate, appoint Supreme Court justices. It says nothing on the timing.

It is by no means a first. It has become common in recent decades, because people are living longer.

Breyer was himself confirmed while Blackmun was still sitting (Blackmun had announced his retirement ‘pending confirmation of a successor’). Same thing happened with Sandra Day O’Connor, and a couple others I can’t recall now.

They announced that Justice Bryer had decided to step down. This was a real shock to Bryer, it seemed at the time.

You have to figure they have the mid-terms in the bag, or at least mitigated it sufficiently to prevent investigations and weather the storm until the next general elections.

Xiden will pack SCOTUS, one way or another. You can take that to the bank. Because the next election steal will be so blatant, it will make the last one look like J-walking. After all, who is going to enforce it? Nobody.

The assassinations will increase, and will be stunningly blatant. One of which will be a conservative justice. Again. There is no way conservatives ever come to power again. They can’t, and everyone who has money and power at stake, know it.

Jaquemate en dos jugadas.

They didn't ask him, they told him. No way were thy going to allow another RBG fiasco where they die in office when there is a GOP president.

It will be fun when ‘Not-a-Biologist’ first uses the word ‘woman’ in a hearing.
