He’s says their actions are a “Serious Jolt to the Legal System.”
Their actions are “unsettling.”
The same guy that loved the Resistance Trump haters using the FISA court for cover. He didn’t have a bad thing to say about that.
.
I don’t know how the man writes the word salad that he does and then winds up in concurrance with the other five in the majority. However his mental gymnastics in this current word salad further demonstrates the mixed up intellect that gave us Obamacare.
He misses Alito’s salient point - neither Casey nor Roe had any judicial basis for writing any ground rules about abortion, and stare decis or not how could you aknowldge that and then compromise as if you can merely modify standards that should not have been set by the court in the first place.
He also misses the most fundamental error of Roe - it aborgated the Constitution clear mandate that basic Constitutitional rights are written not by judges, created out of whole cloth, but by we the people through the processes of writing and formally amending the Constitution.
Prove that Traitor Roberts was not the leaker.
“This was judicial restraint”
Agree. Judicial ACTIVISM would have been declaring that life begins at conception and therefore abortion has to be covered under murder laws. Let the states decide that...
.
John Roberts is saying that letting an Unconstitutional Law stand for 50 years - and to continue it - is not “unsettling.”
You look at what the Dems want - and work your way backwards to Robert’s opinions.
Repeal the unAmerican Wickard v Filburn abortion you Traitor.
Roberts said they went too far and their actions were “unsettling.”
>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>
That creep has exposed his cowardly character many times since he arrived at the Court, so this recent nonsense should come as no surprise to anyone!
Your a dolt. Roberts is married
Nothing Roberts has ever said or written has impressed me in the least.
His “concurrence” is likely what delayed the publication of the opinion until the very end of the term.
He is the Bush family’s personal representative at SCOTUS.
Roberts is just Bushie scum.
I like Clarence Thomas’s statement better, which was (in effect), “Lets get rolling on overturning all past unconstitutional Supreme Court decisions”.
>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>
Justice Thomas has the strength of character and intellect Roberts is so obviously lacking!
Roberts wrote that both sides had a certainty on their positions that he doesn’t share. How do you get to be 67 years-old, Chief Justice of the US Supreme Court and not be able to make up your mind on abortion? But he has decided. He’s for the ability to engage in wanton killing up to 15 weeks.
.
This is not even difficult. He was trying to reach out and offer something to the Trump appointees by saying he would concur with the Mississippi case but Roe must be protected.
He came halfway - and they didn’t.
He was happy with the leak and no doubt applied pressure before running out of time to release the opinion.
.
And he can’t define a woman.
He’s from that political wheelhouse.
This guy is the Bush years compressed into one human being.
>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>..
That is a very perceptive observation!
Yes, Clarence Thomas is a beacon of light. Are you as disgusted with some of the “conservative” commenters as me? Basically they say: Don’t worry you can get abortions in other states. Don’t worry we won’t touch gay marriage. Don’t worry you can still have abortifacient contraceptives.
“To take that action based on a new and bare majority’s declaration that two Courts got the result egregiously wrong?”
It is lonely at the top, and getting lonelier.
"That 50 years have passed since Roe and abortion advocates still cannot coherently articulate the right (or rights) at stake proves the obvious: The right to abortion is ultimately a policy goal in desperate search of a constitutional justification."
Roberts has no credibility. He knew that there were 5 votes to uphold the Mississippi law, so he tried to steer the decision toward an uphold-but-save-Roe/Casey. The problems for him were several. He shot himself in the foot by voting with the liberals in the Louisiana abortion case (June Medical) two years ago. As such he has no credibility on this issue with the other conservatives on the court. And, finally, as Alito pointed out, if you uphold a 15-week ban, then a couple years from now, you’re going to find yourself ruling on a 14-week ban or 12-week ban. It never ends. So why not just get it over with and kick the issue back to the states?
At the moment it is the Thomas Court.
And well past time.
