The DEMs have the numbers to do this, pack the court. The number of justices is set by statute, and DEMs control Congress and the executive.
Those hoping all abortion will be banned tomorrow in those states that still have bans on the books shouldn’t get their hopes up too soon, I’m guessing many liberal Federal Judges (with the help of the Justice Department) are going to do the same thing with this ruling that they did with Heller on 2nd amendment issues. They will “invent” new rights to an abortion not based on the 14th Amendment like Roe was, which will require multiple trips back up to the Supreme Court to be struck down. But that will buy them time to perhaps get a friendlier Supreme Court.

I fully expect him to call on Congress to put on his desk a new statute raising the number of justices to 15. That’s what they said they would do and unlike the GOPe they do what they say most times. They control both houses and could use the Reid rule to bust the filibuster in the Senate. Getting five new nominees in by January would be the challenge but if they win in November it’s automatic they pack that court next year.
For the first question, he wants to and needs to STIR up the activists for the Nov election. For the 2nd, he knows as much as what will be loaded into the teleprompter for him.
