The Washington state Supreme Court on Thursday ruled that a person’s race, and law enforcement’s long history of discrimination against people of color, should be taken into account when determining the legality of police seizures.
The court also clarified state law to say that police has seized a person if an objective observer — who is aware that discrimination and biases “have resulted in disproportionate police contacts, investigative seizures, and uses of force against Black, Indigenous, and other People of Color” — would conclude that the person was not free to leave or refuse a request.
“Today, we formally recognize what has always been true: In interactions with law enforcement, race and ethnicity matter,” Justice Mary Yu wrote for the unanimous court. “Therefore, courts must consider the race and ethnicity of the allegedly seized person as part of the totality of the circumstances when deciding whether there was a seizure.”
The case concerns Palla Sum, a person of color, who was sleeping in his car in Tacoma, when police came upon him. An officer ran his plates and determined the car had not been reported stolen.
The officer knocked on the window, asked Sum questions and asked him for identification.
Sum gave a false name and the officer went back to his cruiser to check records. Sum then drove off, crashed into a front lawn and was caught as he attempted to run away.
He was subsequently charged with making a false statement, attempting to flee police and unlawful possession of a firearm, after a gun was found in his car.
But Sum argued his statements to police should be inadmissible, because he was “unlawfully seized” by police after the officer asked for his identification and said that had been car thefts in the area.

Sadly, the United States of America is home to systemic/institutional racism/sexism, and its name is “affirmative action.”
Straight, white males are the only people it is legal to discriminate against, and discrimination against them is required by law.
Translation: Only whites can be arrested, minorities get a free pass and can go on committing crimes.
New motivation for folks to get back their automobile allodial titles (MSO/MCO), throw away their license plates, stop getting billed for auto excises taxes and start traveling with your automobile instead of driving your motor-vehicle.
Should the history of black people committing crimes at outsized rates compared to the rest of the population be considered?

Yep. The powers that be hate straight, white, Christian males more than anyone. At the bottom to them.
Up above that would be straight black/hispanic/asian/etc Christian males.
Then after them would be straight black/hispanic/asian/etc Christian females.
And on and on up.
People, such as these “judges”, who are obsessed with race are properly and necessarily racists ... by definition.
We tolerate it and don’t fight back so they do it.
I remember years ago in the west San Fernando Valley there an apparent school shooter threat called in and the suspect was white. They were stopping white guys and interrogating them. Turned out it was a cop trying to cover up an extramarital affair by creating a crisis. But no one complained about profiling.
Until every white perp starts self-identifying as black...
You understand the last Republican, sort of, the Soviet of Washington had was in 1980-1984. Violated his promise…no new taxes. Raised the sales tax sealed his fate.
This entire state wants to address SYSTEMIC RACISM, look in the mirror, the idiot voters in this state OWNS THE TITLE. I have yet to vote for a dimocRAT in my 68 years on this rock. Ain’t gonna start now.
Since perps tend to prey upon people of a similar skin color, the people this policy hurts the worst are minorities.
