‘Squatter’ with Fake Lease Won’t Leave Chicago Woman’s Home — and Cops Are Powerless

An alleged squatter with a bogus lease is refusing to leave a Chicago woman’s house — and there’s nothing cops can do about it, the homeowner said.

Danielle Cruz told ABC 7 she recently put the three-bedroom Chatham pad on the market but when a contractor arrived to make some final repairs to the vacant home, a stranger was shacked up in it.

Cruz immediately called the cops but when officers arrived, the nightmare house guest allegedly whipped out a fake lease and claimed to have already paid $8,000 in rent, leaving cops powerless to kick her out, she said. “They said, unfortunately, they couldn’t prove she was trespassing,” Cruz told the station, explaining that she now has to go to court and follow the formal eviction process.

There are other methods that can be used to remove the squatters.

Then the property owner can get in more trouble than the squatter. The police may not do anything about squatting, but I bet they have no problem acting on constructive eviction and several other charges.

Be careful in NY. Is it just the city, or the whole state? I’m not sure. But if someone is in your home for over 30 days, that person becomes a legal resident of your home and you need a successful lawsuit to get the person out.

No money has to have changed hands.

I know a guy who had a very similar problem with house he inherited in CA.
In his case he eventually got an eviction order.
The cops carefully and politely removed the squatters property and set it out on the sidewalk.
As soon as they left the squatter moved it back in and resumed living in the house.
When the owner asked the cops to move the squatter again they said he needed a new order.
One of his coworkers was a Hell’s Angel.
When the HA heard about his problem he asked, “Would you buy a couple of beer kegs to make this go away?”.
So the HA had a little beer party, the squatter was physically removed, the squatters stuff went into a wood chipper, the squatter was warned that THEY would go into the wood chipper if they ever returned.
Six months later he was able to sell the house and leave CA.
Sometimes the HA do good things. (Never underestimate the power of beer!)

How could the property owner get in trouble for evicting the squatter if the squatter cannot be found to register a complaint?

I once had legal issues regarding my property. I went to four different attorneys. They all told me they would take my case but I would not win. They were decent incompetent attorneys who told me I would just be wasting my money. So I asked them well what should I do?

They said “handle it”. Do not get the police involved. Just “handle it.”

I don’t have to tell you what they meant. I don’t have to tell you what I did.

He should have had the locks changed as soon as the police were there.

I think they need to be there 30 days - not sure why the police wouldn't remove them at less than 30 days.

In commiefornia if you try anything your property would essentially be taken by the lawyers and by the squatters as compensation for their pain and suffering...

For that kind of service, I’d happily buy them all the beer they can drink that day, and extra for “hair of the dog” the next day. It would probably be more than two kegs ... and well worth every penny.
