Dershowitz to Newsmax: Navarro's Arrest 'Dangerous to Democracy'

The arrest of Peter Navarro on an indictment charging him with contempt after refusing to comply with the House panel investing the Jan. 6, 2021 incidents at the U.S. Capitol sets a precedent that is "dangerous to democracy," Harvard Law Professor Emeritus Alan Dershowitz said on Newsmax Saturday.

"It's as if somebody was called to testify about what he told his priest or his doctor or his lawyer," Dershowitz said on Newsmax's "The Count," adding that Navarro was arrested after he said he would not cooperate because former President Donald Trump had initiated executive privilege.

"He invokes the privilege and immediately gets indicted, instead of the government going before a court and the judge rules whether or not the privilege applies."

If the judge ruled that executive privilege did not apply in the case and ordered Navarro to testify, then he could be held in contempt for refusing, argued Dershowitz.

"But you cannot constitutionally be held in contempt of Congress without a judicial order," said Dershowitz. "But if the shoe was on the other foot and it will be on the other foot if the Republicans gained control of Congress or the Senate, they will use this precedent and go after Biden administration officials and indict them if they refused to disclose information."

This, he continued, makes Navarro's arrest "dangerous to democracy, dangerous through the rule of law and dangerous to the concept of privilege, whether it be a priest privilege or a doctor, privileged lawyer privilege or executive privilege. I'm shocked that the justice department brought it without there being a judicial determination that he was compelled to testify."

This means Navarro's indictment is "unconstitutional," and that's a "real scandal," that is far more concerning than the acquittal of Clinton attorney Michael Sussmann, he continued.

IIRC Jonathan Turley is also on record as saying basically the same thing. You've gotta admire “progressives” who have some sense of decency,morality,civility.You don't see it very often here in the US of A.

Navarro lives in DC, they could’ve arrested him at any time, but they waited until he was boarding an airplane to make it appear he was fleeing.

Dim bumb Derschowitz. Does anyone, anywhere believe the Republicans would use this as a precedent to arrest democrats? Laughable on it’s very face. We’d get some assaholic speech about “the high road” and the dignity of the Senate etc.

Paralleling our downfall with the downfall of the Roman Republic, this is the point in history in the Old Roman Republic where it became routine to murder political opponents.

I had not even thought about that. The propaganda media will probably insinuate that was the reason for the airport arrest. Actually Navarro was on his way to give a speech. It was probably going to be hard hitting on the lawsuit he had recently filed.

The left cannot win in the battle of ideas. Trump exposed this on a grand scale, and this is an existential threat to them. Thus, the shift into a totalitarian regime began January 20, 2021. Trump and anyone who supports him, or his ideas will be persecuted.

The dems have been using the FBI as a private Gestapo for some time and their participation in supporting the Jan 6 Kangaroo Court confirms their continued compliance. When President Trump was in office, he always cited the top FBI officials as being corrupt, but they set the tone for the recruitment and hiring, and the result is the entire organization is rotten. It must be purged top to bottom, but the next [REAL] President MUST have a LOYAL AND PATRIOTIC AG!

In the meantime, Navarro and his legal team need to heed the fact that Dinesh D'Souza was sentenced and served time on trumped up charges, so the precedent for jailing political enemies in the US has already been set.

If the Republicans gain control of congress they should arrest every Dem they possibly can for any reason they can think of. Drag the assh*les out of their homes about 5am and put them in irons with cameras rolling. Then I guarantee this bullsh*t will stop.
