Investigating the SCOTUS leak: Here’s what needs to be done

Chief Justice John Roberts’s announcement of an investigation into the leak of a draft Supreme Court opinion that would overturn Roe v. Wade has led to speculation about the form such an investigation would take and how effective it is likely to be. Based on our many years of experience conducting such investigations we know they can be challenging and disruptive to any organization, much less an institution where collegiality and confidentiality are sacrosanct. There are ways, however, to get to the truth while respecting the court’s singular and delicate ecosystem.

Supreme Court Marshal Col. Gail A. Curley has been charged with investigating the leak, and she has an admirable and impressive record of service to our country. This investigation requires specialized technical knowledge and access to robust investigative tools that might not be readily available to her. Moreover, it’s unclear whether the Marshal or the Supreme Court Police would even have authority to conduct a criminal investigation of the leak, as federal law appears to authorize them to make arrests only as necessary to protect the Supreme Court building, grounds, and personnel.

a very balanced, professional article by two individuals skilled in the field. Also no indication of how far the investigation has progressed. FTA about the about the authors' qualifications:

"Nicholas Peck and Thomas Feeney are senior managing directors at Nardello & Co., a global investigations firm."

In other words it’s none of our business who leaked it. Does anyone really believe we’re gonna get the truth out of this thing either? Does anyone believe if the leaker was in any way conservative, it would not have already been revealed to everybody over and over?

Look, I’m sure they already know the identity of the leaker by now. The purpose of Roberts’ “investigation” is not to expose the truth but rather to sweep it under the rug to avoid “institutional embarrassment,” “the prestige of the court,” etc. etc.

Somebody on NPR, or PBS, opined that the leaker was conservative. Most of us think that it was someone on the liberal side who did this.

The only people who talk about exposing the leaker seem to be on the conservative side. Some Democrats have said they don’t care about who the leaker is, they are most concerned that the pending decision is the end of the world as we know it.

“We have investigated ourselves and found that the person who leaked the draft “really meant no harm”, and feels really sorry for the “mistake”. So with that the matter is closed and we shall not be releasing the name or any other information regarding this issue. “

Everyone pretty much knew that Roe v Wade would be overturned eventually...

Alito did a good job showing that this should have NEVER got to the USSC. It was essentially a "made up" case with a "preconceived" outcome.

Zen Master, my court guy, says no flips. Votes are already locked in. Probably announced Monday.

Leak almost certainly came from Sotomayor’s aide, in which case Rs should begin NOW demanding her resignation. No, it won’t happen right away. Need to build a firestorm so she can be forced out when Trump can replace her, but start now.

The U.S. Supreme Court can no longer be trusted. It is too politicized. That is because it has SEIZED FAR TOO MUCH POWER over the decades.

There is no abortion right in the U.S. Constitution. The morons on the Court who said there was were a bunch of liars.

"Can't talk about it because it's an active investigation."

And it will remain "active" for the next ten years with no clear findings unfortunately.

The whole event (the leak) was quite the win-win for the left. They got their abort base fully agitated and took a healthy dump on the institution of the USSC. Made to order.

There is an outside chance that this was a CIA or N S A hack. Something along those lines done by a rogue agent with access. I doubt the SC computers are very secure.

Others have speculated this is a deep state shot across the bow. A warning that the deep state knows all you do over at the SC. This lessens SC power and increases Deep State power

This “leak” may be the beginning of the end for this out-of-control, politicized court.

This leak was intended to provoke nationwide violence. This is poison completely infecting the Court.

If the Supreme Court cannot act impartially, and has become a tool for inciting violence, it should be completely dismantled.

This Court ordering the murder of the unborn became a barbaric force upon the Roe v. Wade decision.
