Why? If it’s so blatant and common and obvious why not report the actual racist incidents?

If what is alleged actually happened, I don’t why the plaintiff’s attorney would drag race into this at all, except to dare the crap out of the defendant’s attorneys and/or Jack the payout.

The notion that any injury to a black person is due to racism is now fully embedded in our culture. I see it all the time at work. There are multiple black people that fully and irrationally believe any criticism of their work is racism.
No the racism is about not following up on the subsequent symptoms.

Yes. It is a fact that 50% of surgeons graduated in the lower half of their class. There are a few great ones, a lot of competent ones, and always a number of bad ones.
