The independent state legislature doctrine says that, under the Elections and the Electors Clauses of the Constitution, state legislatures possess plenary and exclusive power over the conduct of federal presidential elections and the selection of state presidential electors. Not even a state supreme court, let alone other state elections officials, can alter the legislatively written election rules or interfere with the appointment of state electors by the legislatures, under this theory.
It’s always been my understanding that the constitution authorizes state legislatures to select methods by which presidential electors are chosen. Every state chooses electors by popular vote within the states. A state could choose electors by some other method.
Maybe I’m missing the point of this article. He makes it sound as if it is a threat to the survival of the nation, if people take these parts of the constitution and the Electoral Count Act seriously. Is it a threat to apply those legal provisions to situations, in which there are questions or problems regarding the conduct of the elections by which electors are chosen?
But maybe I’m just missing something. State legislatures have always had the power to choose electors, but apparently shouldn’t exercise that authority according to him.
It’s a threat to the constitution to follow the constitution?

Laura Ingram. Her arrogance demanding Judge Luttig be appointed was one of the first reasons I didn’t like her.
Another was her going on about John Roberts being “courageous” and “heroic”, when all he ever did was be a puke at a big law firm.

Appellee Jose Padilla, a United States citizen, associated with forces hostile to the United States in Afghanistan and took up arms against United States forces in that country in our war against al Qaeda. Upon his escape to Pakistan from the battlefield in Afghanistan, Padilla was recruited, trained, funded, and equipped by al Qaeda leaders to continue prosecution of the war in the United States by blowing up apartment buildings in this country. Padilla flew to the United States on May 8, 2002, to begin carrying out his assignment, but was arrested by civilian law enforcement authorities upon his arrival at O’Hare International Airport in Chicago. Thereafter, in a letter to the Secretary of Defense, the President of the United States personally designated Padilla an “enemy combatant” against this country, stating that the United States is “at war” with al Qaeda, that “Mr. Padilla engaged in conduct that constituted hostile and war-like acts, including conduct in preparation for acts of international terrorism that had the aim to cause injury to or adverse effects on the United States,” and that “Mr. Padilla represents a continuing, present and grave danger to the national security of the United States.” Having determined that “detention of Mr. Padilla is necessary to prevent him from aiding al Qaeda in its efforts to attack the United States or its armed forces, other governmental personnel, or citizens,” the President directed the Secretary of Defense to take Padilla into military custody, in which custody Padilla has remained ever since.

Sorry Mr. J. Michael Luttig. Conducting elections through “Independent state legislatures” is not simple doctrine. It’s hard wired into the Constitution. If you don’t like it then you can propose an amendment, butthead.
