Trump-appointed judge triggers cheers and fears with US mask ruling

She has become an instant heroine of the Republican right.

In a 59-page opinion on Monday, the US district judge Kathryn Mizelle of Tampa, Florida, overturned the federal requirement that people wear masks on planes and public transportation.

Congressman Byron Donalds hailed her “courage” and “common sense”. The far-right activist Jack Posobiec praised her as a “patriot”. Matt Schlapp, chair of the American Conservative Union, tweeted: “God Bless Judge Kathryn Kimball Mizelle!”

Mizelle’s decision triggered cheers and fears in the skies. Some passengers removed their masks with glee. Others thought the move hasty and questioned how a lone 35-year-old judge on the district court for the middle district of Florida could wield so much power over millions of lives.......

She pointed out that Mizelle was an active member of the Federalist Society, which advocates for an originalist interpretation of the constitution and has spent decades working to shift America’s courts to the right. Mizelle is also an adjunct professor of law at the University of Florida Levin College of Law.....

“The left’s hatred for President Trump led it to turn the federal courts into a national injunction machine that showed little deference to the executive branch or the limits on district court judges. Liberals now have to live with this new legal regime they brought about.”

Levey added that the left’s unhappiness with the idea that a young judge appointed by President Trump could wield this power “really has nothing to do with her age and everything to do with her being a conservative appointed by a president they despise”.

I read the decision and it is very sound from a legal standpoint.

Ironically, the decision is a blueprint for knocking down about half of what our government is currently doing where they use regulation and bureaucracy to create “law” instead of requiring congress to pass a “law” as our constitution demands.

I did not real “politics” in the document. It was pure law.

“originalist interpretation”

That phrase connotes something reactionary. All it really means is that courts should follow the intended meaning of laws, and not just make things up.

They certainly miss out on irony.

I find it ironic that they cheered judges who stepped far outside the law regarding Trump’s enforcement of immigration law yet they decry a decision by a judge that was fully supported by case law and the constitution.

Few will bother to read or attempt to understand her decision and that is a shame. She wrote a treatise on how/why about 50% of our government and government spending is unconstitutional in my humble opinion.

Not that I mind rare instances when the judicial system isn’t liberal left but since when has any judge become a law maker deciding for everyone? But, And don’t try give them hot potato like ‘election stealing 2020’ & supreme us court, oh no we’s don’t want that sponsibility .

What bias...in every video I've seen MOST passengers removed their masks with glee. Those who didn't were few in number.

Californians, at least those who’ve been here awhile, are painfully aware of how one judge can usurp the will of millions of people.

This would be a completely different state - a much better one - if it were not so.
