WASHINGTON (AP) — A lawyer for the Hillary Clinton campaign charged with lying to the FBI during the Trump-Russia investigation is asking a judge to block from his upcoming trial evidence or testimony related to a dossier of uncorroborated allegations compiled by an-ex British spy.
Attorneys for Michael Sussmann said prosecutors on special counsel John Durham’s team told them last month that they plan to introduce testimony related to the so-called “Steele dossier,” a collection of Democratic-funded research assembled by former British operative Christopher Steele that purported to link Donald Trump to Russia. The dossier contains unproven and discredited assertions but the FBI relied on it in part as agents applied for secret surveillance warrants during the Russia investigation.
Sussmann’s attorneys argued in a Monday night filing that the Steele dossier is irrelevant to the case against their client, and that testimony about it at a trial scheduled for next month would be inflammatory and prejudicial.
“Any modicum of relevance would be so substantially outweighed by risk of confusion, delay, waste, and unfair prejudice as to require this evidence be precluded,” Sussmann’s attorneys wrote, telling U.S. District Judge Christopher “Casey” Cooper that Durham’s team should not be permitted to turn the trial “into a circus full of sideshows that will only fuel partisan fervor.”
The motion is one of several from both prosecutors and defense lawyers aimed at shaping the scope of evidence for a trial that is expected to be closely watched and politically charged. In seeking to preclude testimony related to the dossier, Sussmann’s attorneys are looking to head off discussion before the jury about one of the more incendiary and divisive aspects of the entire Russia investigation.

Well, I think the motion will probably succeed. After all, Durham filed the case about lying to the FBI on the matter of the fake Alfa Bank allegations, not lying to the FBI on the matter of the fake Steel dossier.
So it is going to be hard to show how the Steele dossier is relevant, since it post-dated that incident. I suppose if Sussman was later involved with the dossier they would argue it shows a pattern of behavior but I don’t think a judge will allow it.
As John Solomon said, Durham introduced The “C” Word — conspiracy. The dossier is at the heart of the conspiracy and has many fingerprints on it.
It is the central axis of the case.
However, Conservatives and pro-Trumpers can be very pleased that a criminal defendant has been forced to publicly state that the dossier is "uncorroborated allegations compiled by an-ex British spy."

Hopefully, Sussmann’s lawyers will bleed him dry before he goes to prison.
Seems to me this goes to the issue of motive. Very relevant.
And materiality of the false statement.
This is normal in trials. Both sides file motions they know will get rejected. What is not normal is the AP covering this.
One could argue that the allegations of impropriety between Trump and Alfa bank are "fruit of the poison tree", a doctrine that extends the exclusionary rule to make evidence inadmissible in court if it was illegally obtained. Sussmann is a partner in Perkins-Coie, the front men for the dossier, and as a lawyer, an officer of the court.
It shows the lie to the fed's to be a conspiracy!
I did not work for the Hillary campaign.
I didn’t lie to the FBI regarding a dossier.
