One of the most far-reaching vaccine bills introduced in the California Legislature this year will not move forward as planned, after the proposal to require all workers to be inoculated against COVID-19 was shelved on the eve of its first hearing.

Since the perception is that the un-vaxxed are mostly right-leaning, this is a thinly veiled operation to cull all right-wing State lawmakers, All Judges, and all local officials from the State. This can never pass in any form.

(2) “Public employer,” for purposes of this section, means:

(A) The state and every state entity, including, but not limited to, the Legislature, the judicial branch, the University of California, and the California State University.

(B) A political subdivision of the state, or agency or instrumentality of the state or subdivision of the state, including, but not limited to, a city, county, city and county, charter city, charter county, school district, community college district, joint powers authority, joint powers agency, and any public agency, authority, board, commission, or district.

Can you imagine being a Judge or State Senator or Congresscritter, elected by the people and being booted because you refused to be jabbed?

I think their problem is much simpler than codifying what a “worker” is by delving into the intricacies state law, employers and government entities as employers.

The USSC has already ruled that employer mandates are unconstitutional except in the case of hospitals, healthcare providers, etc. This proposal is just an end-run try around that by changing ‘employer’ to ‘worker,’ and would fail eventually.
