OKLAHOMA CITY (AP) — A high-profile Oklahoma attorney is asking the state Supreme Court to stop the special election for Oklahoma’s open U.S. Senate seat, arguing the U.S. Constitution does not allow a special election to fill the post until it's vacant.

The governor has been informed that a vacancy will be occurring. And as a result, the governor is ensuring that THE PEOPLE will be able to choose a NEW REPRESENTATIVE in the national legislature.
I understand the politics of it - Democrats would like one less Republican for a period.
But getting a new representative elected when people will be voting for OTHER representatives anyway is hardly a violation of the letter or spirit of the Constitution.
There is no vacancy until Jan 2023. Constitution has to rule.

Agreed. When it comes to clear issues of constitutionality, we can’t descend to the lawlessness of the other side.
The issue I have is why did then 87 year old Imhofe run in the first place? Is his ego that big? Did OK not have a winning choice otherwise?

Pretty cut and dry. A vacancy has to occur first.
So Inhofe quites Nov 1 before the actual election.
He’s not doing squat anyway and misses a lot of votes.

So let him resign the day before the election—and the winner to be sworn in the day of or after the election.

I've been impressed by some of Dahm's comments, but will reserve judgment until, and if, he's elected.

The Constitution does not prohibit this. It says the state executive may issue “ writs of election” (call a special election) or if permitted by the state legislature may appoint someone. it does not say specifically that the office must already be vacant to call a special election. Since the process being used was passed by the state legislature, I don’t think he is going to win this one.
Dahm is great, he’s never wavered. I don’t know how well he’ll fare in DC. That Rand Paul endorsement was a game changer. As long as DJT stay’s out he’ll have a shot.

As far as his plumbing business is concerned, he's out. He sold it last December.
