Alexandria, Virginia; February 25, 2022: Today, a federal judge ruled that Fairfax County school officials violated the law by changing admissions requirements at the nation’s top public school to deliberately reduce the number of Asian-American students enrolled.
Last March, a coalition of parents, students, alumni, and community members filed a lawsuit challenging admissions changes at Thomas Jefferson High School for Science and Technology (TJ).
“This is a monumental win for parents and students here in Fairfax County, but also for equal treatment in education across the country,” said PLF attorney Erin Wilcox. “We hope this ruling sends the message that government cannot choose who receives the opportunity to attend public schools based on race or ethnicity.”
Until last year, admission to TJ was race-blind and merit-based; requirements included a standardized test, grade-point average, completion of certain math classes, and teacher recommendations. Last year, the Fairfax County Public Schools’ board and superintendent adopted an admissions policy aimed at balancing the racial groups at TJ by eliminating the admissions test, guaranteeing seats for 1.5 percent of each middle school’s eighth grade class, and awarding bonus points for various factors such as attendance at a middle school previously underrepresented at TJ. The intended result: dramatically reducing the number of Asian-American students admitted to TJ.
Pacific Legal Foundation represents the Coalition for TJ free of charge. Coalition for TJ v. Fairfax County School Board was filed in the United States District Court for the Eastern District of Virginia, Alexandria Division. Judge Hilton granted the Coalition’s motion for summary judgment, giving them a win in the case.
A federal judge ruled today that Fairfax County Public Schools broke the law by committing racial discrimination in the name of "equity." The FCPS school board turned the top-performing math school in the nation into a school that provided remedial math to get rid of Asians.
The finding comes a day after FCPS said it would file an amicus brief in a federal lawsuit in order to avoid complying with a state law that says schools may not require kids to wear masks, considering coronavirus poses no particular danger to children.

It's unfortunate that cowardly conservative leaders often hide behind minorities to push conservative policies.
* Defunding the police is bad because it hurts blacks.
* Race-based admissions is bad because it hurts Asians.
* Uncontrolled immigration is bad because it hurts blacks.
Conservative leaders dare not suggest that whites have any interests that deserve defending.
If college admissions were based only on SAT scores and GPAs, Asian-Americans would be the majority of all US colleges (fine with me).

The motivation was to limit Asian participation. The major impact was to limit Asian participation. There is no hiding behind here. The new policy as written would have much less impact on whites. I like this case.
If whites can’t compete then they deserve what they get.
This isn’t affirmative action that basically excludes whites even if they are qualified.

In today’s world, if you don’t loudly demand your rights, you will be quietly ignored, sometimes not so quietly.
Asians, Whites and males are just now learning this message on a large scale.
W publicly spoke out against “the soft bigotry of lowered expectations”; if blacks don’t oppose these lowered expectations, they are doomed. Race- and gender-based affirmative action are a public admission by government that some people are genetically inferior to others.
As guvs, IIRC, they had the 10% solution, whereby bad students at low-performing school were put ahead of other students for college, despite merit. They were very proud to proclaim how they had got to affirmative action results with not using hard quotas at the college acceptance end.
