A judge has denied a family’s request for a speech-delayed 3-year-old boy with learning disabilities to attend preschool without a mask.
Judge Jeffrey Rabin ruled that the child did not qualify for the emergency relief his mother, Katherine Hart, requested.
Hart’s lawsuit against the Medford Lakes School District asked that her son be allowed to start preschool immediately without a mask requirement for the entire school day, on the grounds that he had not attended preschool since Jan 18.
The school argued that it was Hart’s choice to hold her son back from preschool. Hart has acknowledged this, saying she did not send him to school because her non-verbal child would not be able to cope with the frustration and anxiety of having to wear a mask in a new environment where he is already at a disadvantage because of his learning disability.
In his ruling, the judge agreed with the school that the break in services for the child was brought on by Hart's decision to keep him home until the mask issue was resolved and was not the school’s fault, which disqualified her request for emergency relief.
Hart was also unable to prove the “irreparable harm” her son would suffer if he attended preschool with his mask and in compliance with the mask mandate, the judge wrote.

Hart did not send her son to preschool after the administration's denial of her request to amend his Individualized Education Plan (IEP), part of a state-approved program designed for special needs children, with an exemption from the mask mandate.
The law that mandates masks in school during the COVID-19 emergency makes an exception for children whose IEPs say they are unable to wear masks. The school refused to issue this exception.

The really off thing, is that NJ had been very supportive of IEPs given the very high rates of autism in the state. This sounds like pure politics.
IMO it would be very difficult to find a “judge” today in any court who didn’t make political decisions!! We see it every day - no logic to decisions that are made.
I realize there’s no black and white to such matters, but most 3-year-olds learn to talk at home, not in school. I wonder if the mom has given any thought...well...never mind.

I’d sue the school district and force them to provide a one-on-one speech instructor. Since masks are required in the skool, I’d force the speech instructor to come to the house.
speech delayed... he hasn’t seen peoples lips move to form words to help him learn to speak in two years, and this helping that how???
School? He’s 3.

the welfare of the average person does not play into decisions made by the powers that be. They only claim that kind of benevolence to get what they want without people objecting to it.
Up here in the hinterland of Wisconsin students have been mask-free for months. Sports, plays, events are all back to normal.
Now that's REAL science, vs political science.

This branch of Government requires a law degree. That means one branch of Government is entirely trained by a few institutions. Grab them, and you can indoctrinate 1/3rd of the US Govt.

So true and I’m ready to STOP getting frustrated/irritated/angry at what’s happening. I despise pessimism but I’ve got to be a pessimist at this point as they have us beat as far as I can see. There’s only so much of the ridiculous stories that we are deluged with every day that we can take without hollering UNCLE...Seeing what’s happening in Canada - who can believe that’s right or normal? The Canadian people seem to agree with what their government is doing!! THAT by itself is unbelievable! Is that going to happen here? Is it happening here?
The situation in Canada is disheartening to say the least.
Who knows what is going to happen next and what the people re going to do?
