Rudy Giuliani said that if Trump had imposed martial law after the election, 'we would all end up in prison,' report says

Former New York mayor Rudy Giuliani said that if then President Donald Trump had imposed martial law in an effort to overturn the 2020 election results, the former president and many of his aides would have wound up behind bars.

That's according to Patrick Byrne, the former head of Overstock, who told The New York Times that Giuliani recently explained to him that he advised Trump against imposing martial law because "we would all end up in prison."

The Times has previously reported on Giuliani's opposition to instituting martial law. Despite his own endorsement of outlandish conspiracy theories about voter and election fraud, he became alarmed when former national security advisor Michael Flynn and former Trump lawyer Sidney Powell suggested imposing martial law.

According to the paper, Flynn, Powell, and Byrne went to the Oval Office on December 18, 2020 and laid out a plan that involved deploying the military to seize voting machines and ballots in key battleground states. Giuliani waited until Flynn and Powell had left the Oval Office and told Trump that their plan would get him impeached, the report said.

There was no chance of martial law anyway. The senior levels of the military were solidly on the side of the coup

And that would have been led by Chairman of the Joint Chiefs of Staff Mark Alexander Milley.

After everyone that was following along on election night discovered the President had been in a SCIF that night and then his location was not known for another 36 hours it was speculated he was setting up the capture of the insurrectionists.

Then suddenly he was back in public (more or less) and nothing was developing.

At that point I figured he had been told that the military would not follow his orders.

Milley had turned his back on the Commander in Chief and his actions and statements during the ensuing year bore that out.

It is a shame that Milley will never hang for his crimes.

Yes...but as slimy as Gore's effort was, all the challenges he made were within specific time periods and followed the procedures set out in statutes. They did not violate any of the dates set out in state or federal law, and they were all resolved before the EC voted.

Pence would have been acting without any court authority, and outside any statutory process. No constitutionally-based time limits on his alleged authority to delay.

It would have been an absolute disaster, and had it happened, a whole bunch of folks who voted for Trump would have deserted him. It would have been a disaster.

First question: When did Trump ever suggest martial law in response to the election? Because he used lawyers, not executive authority.

Despite all the talk over Trump declaring martial law, there is no evidence he actually considered it at all.

We were looking at the wrong places. Mark Zuckerberg spent over $400 million dollars to “support” local elections boards. If he broke the law there, then we need to charge him.

I respect Giuliani for giving Trump the proper advice, instead of the “fantasy world views” of Flynn.

Trump would’ve been impeached anyway, but declaring martial law would’ve guaranteed a conviction in the Senate.(they were only 10 Senators short on the phony inciting an insurrection charge)
Besides being an extra or unconstitutional move, it wouldn’t have worked because nobody would’ve followed that order

The conviction would’ve been the end of Trump’s political career.
So it would’ve been a terrible move for Trump & his supporters.
But at the “end of the day” it doesn’t matter because it never happened. IMO asking advice from advisors isn’t impeachable.(the wokecrats probably see it differently, but F them, they’re stupid people.)

The issue is the GOP members of state legislatures did not do their jobs.

In the presence of doubt about their states’ counts, it is THEY who should have defined the slate of electors and counted them up and sent their count to Washington. This is what the Constitution says and what they should have done.

The GOPe at the state level created the entire absurdity.

He wanted obvious fraud investigated before the election could be certified.

This is not the first time "certification" of the election has come up. This is supposed to be a pro-Constitution website.

And, as such, all should agree that the President is to be appointed by the State Legislatures, using an indirect method.

The involvement of Congress in the process was discussed at length at the Philadelphia Convention, and was rejected.

The public counting of votes in the presence of all Senators and all Representatives is meant to prevent after-the-fact complaints that the counters cheated.

But Congress does not "certify" the election. If you believe that they do, then please show me text that confers such a power on them.

Well, in her defense, the “justice” system would not look at the evidence and abdicated their responsibility entirely. An entire branch of the Government threw in with a color revolution.

Bryne’s near-contemporaneous accounts paint Rudy as “not on top of what had occurred.”

We need to quit eating our own and admit that on election eve, Election Day and after the election, President Trump was not on top of what was happening or what could be done about it. That is why he could not get concurrence with Pence as to what action, after fifteen other options might fail, Pence might resort to in a manner he could justify. That is why no ground work was laid for Pence to be the last resort.

Not only did Trump miss the boat, but Free Republic missed the boat. Conservative media missed the boat — in fact a good part of it torpedoed the boat after another part had held a Bon Voyage Party for the boat.

The State Republicans missed the boat. The prognosticators missed the boat. Ask LS if any of the countless prognosticators he was communication with foresaw what was happening in any sort of scale to what occurred.

We simply did not realize that the leftist establishment was ready to destroy the nation — we thought they were still working up to it.

I used to hope that Trump would have taken back Oval Office months ago. The problem with that oversimplified thinking is that Trump first needs to finish draining the swamp as a private citizen, free of constitutional checks and balances of Oval Office powers, before going back to office.

After all, what good are his famous business skills if he’s surrounded by a very corrupt deep state that refuses to support his vision for MAGA?

Who knows, maybe three, possibly four mock impeachments by now?

Insights welcome.
