Court finds Pennsylvania mail-in voting law unconstitutional

(WHTM) – The Commonwealth Court of Pennsylvania has found the commonwealth’s no-excuse mail-in voting law, Act 77, is unconstitutional.

According to court documents, 14 members of the Pennsylvania House of Representatives filed a petition to block the 2019 law that would allow any qualified voter to vote by mail.

The law allowed voters to submit a ballot by mail up to 50 days before an election and placed voters on a list to permanently receive a ballot application by mail. It also established 15 more days to register to vote and extended amil=in and absentee submission deadlines.

Act 77 also outlined rules for voting machine decertification and appropriated funding for voting machine upgrades that provide a verifiable paper trail.

Maybe, it depends on how your state constitution reads.

We need a federal Constitutional amendment that in very simple terms modifies Constitutional language as to the timing of certifying federal election results with the very simple addition of “except when court challenges to the election results are (a) underway, (b) being filed, (c) have petitioned the supreme court for a delay as either (a) or (b) are being prepared, and no results will be certified while (a), (b) or (c) are in process and pending their final outcome.

Biden would have never held the Presidency.

Huge story. The constitution is upheld. If you want universal mail in ballots you have to legislate. Next: consider a decertification resolution.

Our local fizzano-cannon was in on that decision. She struck down the recent school mask mandates also.

Maybe, it depends on how your state constitution reads. >>> the state constitution clearly says you can’t have unlimited mail in ballots. Here it is.

§ 14. Absentee voting.
(a) The Legislature shall, by general law, provide a manner in which, and the time and place at which, qualified electors who may, on the occurrence of any election, be absent from the municipality of their residence, because their duties, occupation or business require them to be elsewhere or who, on the occurrence of any election, are unable to attend at their proper polling places because of illness or physical disability or who will not attend a polling place because of the observance of a religious holiday or who cannot vote because of election day duties, in the case of a county employee, may vote, and for the return and canvass of their votes in the election district in which they respectively reside.
(b) For purposes of this section, “municipality” means a city, borough, incorporated town, township or any similar general purpose unit of government which may be created by the General Assembly.
(Nov. 5, 1957, P.L.1019, J.R.1; May 16, 1967, P.L.1048, J.R.5; Nov. 5, 1985, P.L.555, J.R.1; Nov. 4, 1997, P.L.636, J.R.3)

If such a Constitutional amendment existed the Rats will judge shop and contest every election they lost. They would still have the 1992 election in court!

Also such an amendment would make the courts the arbiter of last resort of presidential elections not the states. (Why do people think the courts are magically honest?)

All of this is because we have moved far away from the Founders intent and made the Presidential election the national equivalent of electing Prom King & Queen. The state legislatures ultimately decide the presidency. That was the intent of the Founding Fathers. We have allowed them to abrogate that responsibility by passing it to popular vote. We the people helped create this expensive circus-like mess we call presidential elections. I guess we find it entertaining its certainly not the Founding Fathers intent. Just another example of moving away from the Constitution because its inconvenient, requires too much citizen responsibility.

I've thought and rethought( read many times!) the USSC decisions or non-decisions on the 2020 election. The message imperfect as it is ‘ It's the state legislatures responsibility! If they are fine with corrupt elections then OK !’ In some states (key states!) these state legislatures obviously are ! They have allowed it to go on in some counties and urban areas for decades ! DECADES! Due to fear of the Race Card! This negligence was taken advantage of on an industrial scale ! Then throw the COVID panic and we have what we have !

Next: consider a decertification resolution.

That ship has sailed, and the dock is now under water.

Legal procedure to remove illegally-seated officials, or officials caught in criminal acts, is a quo warranto ('by what authority'). Courts are out of it due to the plenary powers granted in the US Constitution between state and federal legislatures to determine election rules and results. A court can rule that election laws were broken or not, and whether a fraud occurred, but final resolution rests with the legislatures. An example is the actions taken after our Civil War in denying states seats in Congress for a time. Today's problems are not from a Confederacy of states, but from a political party that should be de-certified for its bad manners.

We have a Democrat run Supreme Court in PA that will overturn this decision giving the Republicans something to make us all mad about for the election this fall.

This is huge.

Each time one of the stolen swing states wins a victory like this, more of the Left’s November 3 narrative crumbles.

Rather than proving the election was not stolen - by submitting to full forensic audits and re-canvases - the Left’s narrative has always been that allegations of a stolen election are “misinformation” and “conspiracy theory” - not worthy of a response.

As long as the Leftist media monopoly can suppress the truth through censoring and gaslighting, the general public will be deceived - but the media blackout needs to be 100% to be successful.

This makes the Left’s position extremely fragile - all it will take is a few cracks and their wall of lies will come tumbling down. If one of their lies is exposed, the others will follow.

PLEASE, PLEASE, PLEASE - let it happen soon! We can’t allow these liars and thieves to go unpunished any longer.
