did they have a choice?
The Biden Administration must have got the heads up they were about to lose the case.
Don’t think this will not stop them from trying again, and going back to the courts.
See post #3
The OSHA mandate had temporary status. OSHA is now going after PERMANENT status for the mandate.
According to some dude on Twitter.
And that’s good enough?
290k followers and he only posts what is in the news.
Sorry you have not seen it yet.
Do a search on it.
Yes, they had a choice.
They could have fought the stay at the 6th circuit court of appeals. Won in that court again. And then double dog dared the Supreme Court to overturn the 6th again.
Instead, they went with ATTACK OPTION #2.
They are going for the PERMAMENT RULE !!!
Here is what they said... https://public-inspection.federalregister.gov/2022-01532.pdf
1. Background and Rational for Withdrawal:
....
That ETS also serves as a “proposed rule” for
a “proceeding” to promulgate an
occupational safety or health standard.
29 U.S.C. 655(c)(3); see 29 U.S.C. 655(b).
....
Although OSHA is withdrawing
the Vaccination and Testing ETS
as an enforceable emergency temporary standard,
OSHA is not withdrawing the ETS
to the extent that it serves as a proposed rule
under section 6(c)(3) of the Act,
and this action does not affect the ETS’s status
as a proposal under section 6(b) of the Act
or otherwise affect the status of the
notice-and-comment rulemaking
commenced by the Vaccination and Testing ETS.
See 29 U.S.C. 655(c)(3).
Isn’t that basically saying “we’d like to impose this IF we had the authority to do so”? (Which the USSC just told them they did not have?)
I mean, they can propose whatever they want...doesn’t mean they can, or will ever be able to, follow through.
they never intended to push this forward with vigor. They all knew it was BS and they did it anyway hoping that companies would just do it. They were right and it worked to some degree.
Put a fork in it, “it’s dead Jim”!
......our bank for many years has been Wells Fargo....their employees are ALL still masked up, even when no customers are in the lobby, in line, nowhere...!! and even when they are yards and yards away from their fellow employees... one of their tellers told me, hey, we have learned to live with it....sad.....
I think Wells is as woke as you can get.
Of course they are. Thanks for posting truth.
