State judge overturns NY mask mandate

MINEOLA, N.Y. (AP) — A New York judge ruled Monday that the state’s mask mandate can’t be enforced, after it was reinstituted by Gov. Kathy Hochul over concerns about a winter surge of coronavirus cases.

State Supreme Court Judge Thomas Rademaker said in his decision that the state Department of Health didn’t have the legal authority to implement the mandate, and that it was up to the state Legislature to do so if needed.

The mandate “is a law that was promulgated and enacted unlawfully by an executive branch state agency, and therefore void and unenforceable,” the judge said.

The state had initially instituted a mask mandate in April 2020 that ended in June 2021 for vaccinated individuals; Hochul announced in mid-December that it would go back into effect for at least a month. Earlier this month, the state health department said the mandate would be in place until Feb 1.

Up here in NW Ontario County not many have paid attention to it anyway. All the stores, bars, restaurants etc., have the required signs up but they’re ignored. No staff or employee say anything. I’d say 1 in 10 are masked but almost certainly by choice.

People are done with this nonsense

Early on in this whole debacle, we were in a business that had the signs up about governor cuomo’s orders and they told us they didn’t really care but left the sign up in case TPTB came snooping around trying to find people not enforcing the masking.

The Governor should ask the legislature for “state of emergency” but if she didn’t get the powers from them, then she did not have the authority in the first place, as simple as that. The crisis is over. Now we have to live with it. Mask mandates and things like that are best up to the local government.

I work for Wegmans in Monroe County and while most customers wear masks, there are more and more customers coming in without masks today. Now I’d say 50% are not masked; despite all the businesses still have these billboards at the entryways. I see only one advantage of these masks: they remind me to brush my teeth more than twice a day...

Don’t the dems have a supermajority in NY? If so, then the legislature will just issue the law to reinstate them, or maybe pass something that allows the governor to edict them.
