James Clyburn defends federal takeover of elections: 'Cannot be left up to the states'

Rep. Jim Clyburn, D-S.C., defended federal involvement in elections, citing Alexander Hamilton while claiming election loss "cannot be left up to the states."

This week marked one year since the Jan. 6 Capitol riot that occurred on the day that Congress set to certify President Biden’s win in the 2020 election over former President Donald Trump. The controversy around the post-election days focused on Trump’s efforts to challenge election losses in key states, including Georgia where State Secretary Brad Raffensperger famously rebuffed the then-president’s effort to find more votes.

The Constitution says THIS:

"The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."

Federal Government involvement is indefensible, from a Constitutional perspective, unless it prevents people from participating based upon one of the other Amendments.

The left contention that people are blocked from legal voting is non-sense and utterly disgusting. Illegal voting is what they are advocating, because without illegal voting they will be held to account. Every single state audit has demonstrated enormous voter irregularities. The press and democrats try to downplay the votes without signatures, the ballots that have no chain of custody, the double vote, but together they are larger than the margin of victory. The left knows they have a big bill to pay when people get a chance to speak.

James Clyburn vs Madison and Jefferson. Let’s see, whose intellect do I admire and trust more? Not really a tough question, really.

If they can pack the Supreme Court with Lefties, there is no need to follow the Constitution.

The Congress has the authority to alter state rules for elections of Senators and Representatives (Article I section 4).

As I posted here...

Here is my conundrum:

Article I, Section 4, Clause 1: The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
The bolded part makes it seem that Congress can federalize its own elections if it wants, but it cannot change the places where Senate voting occurs.

This, to me, implies two things:

  1. States can still ban mail-in voting for Congress, as this is a "place of choosing Senators."
    • Note that this clause "chusing Senators" predates the 17th amendment when Senators were chosen by state legislatures. I have not seen on-line Constitution text sites that highlight this clause as being changed by the 17th amendment.
    • If this clause was not struck by the 17th amendment, then it bifurcates Congressional elections. This means that Congress can fully mandate how House elections take place, but not the place of voting for Senators.
    • This will allow states to treat House and Senate elections as two distinct elections, each with their own ballots. House elections will follow Congressional procedures, and Senate elections will be split between Congressional and state requirements.
    • I can see an extreme case where Congress approves mail-in voting with 7-day post-election windows to receive them FOR HOUSE ELECTIONS ONLY, while Senate elections can still be held at Election Day polling places only if state legislatures choose to do so.
  2. Presidential elections are outside the scope of Congressional authority given in Article I Section 4 Clause 1. Article II Section 1 Clause 3 still gives the states full control over the "manner" in which "each state shall appoint Electors."
    • This means that we can see four separate elections on "election day," each with their own manners of occurring.
      • Presidential elections under complete control of the states.
      • Senate elections where the manner is under the control of Congress, but the place of holding the voting is under state control.
      • House elections where Congress has full control over the manner of holding the election.
      • State office elections, under full control of the states.
This is a recipe for total chaos in our elections.

"Communist scum."

Black supremacist statist scum.

I think he was the key player in throwing SC to Biden in return for a blackish VP on the ticket. Biden won SC, and almost every candidate threw him their votes and support.

I would love to know the details of the backroom bargaining.

Our ancestors would be shooting by now. That is pure tyranny, and the whole reason the founders set up federalist system.
