Equal Justice? Contrasting Potter and Baldwin

Comparing the Kim Potter and Alec Baldwin cases is a powerful illustration of the missing element in our criminal justice system. Prosecutors are granted broad discretion in who they charge, so that they may consider the totality of circumstances and provide something that the literal interpretation of laws can’t -- justice. But the Potter and Baldwin cases show just how far astray from that goal our systems have wandered.

Interesting contrast. Baldwin shoots two people, killing one and is not brought to justice. Potter in the line of duty kills a criminal evading arrest. She is immediately prosecuted and sent to jail.

Our legal system is consumed with politics. The broad discretion granted to prosecutors seems to be a mistake, in my opinion. I would be happier with more literal interpretation of the laws. Let juries decide, and perhaps allow more discussion of jury nullification -- if more "discretion" is warranted allow the jury to just say "let him go" rather than allow the prosecutor to say "If I prosecute this guy, I'll look bad".

Baldwin should have been Arrested on the spot and should still be in the lockup awaiting Trial for Manslaughter.

Potter and Baldwin……not sure that’s a comparison.

Potter and Byrd…..that’s the comparison.

Potter…..a diminutive female, fighting with a convicted felon, with outstanding warrants, trying to get away from the cops, grabs her pistol instead of Taser and shoots him. She’s looking at 25 years.

Byrd…..a large black MAN, sees a diminutive white female climb through a window, does NOT challenge her, does NOT attempt to tell her to stop or get on the ground, does NOT attempt to arrest her, INTENTIONALLY shoots and MURDERS her. She did NOT pose a threat of death or serious physical injury, nor did she have a weapon, ergo the elements to use Deadly Force-Ability Opportunity Jeopardy-were not present. He was comforted, consoled and congratulated for a job well done by Republicans in Congress.

The left wanted Cheney to be charged after his hunting accident.

But the left will dismiss Baldwin’s murder of one as an “accident”

Potter killed a black. Baldwin killed a white. Potter was a cop. Potter was prosecuted by Keith Ellison, a known racist. Baldwin is loved by the left for hating conservatives. Potter was overwhelmed by the urgency of the situation, and unable to reason clearly. Baldwin calmly shot the gun and afterwards refused to take any blame.

Potter was genuinely confused and has little personal moral guilt in the matter, but still has full responsibility for the death. It’s not murder. She has to pay a penalty, either criminal or civil.

Baldwin was totally lucid. There was no urgency of the situation. Regardless of the established practices of the crew, he bears responsibility for the effect of the bullet. He pulled the trigger. Regardless of what he and the prop manager thought, regardless of assurances that the gun was safe, he has the responsibility to check the gun to make sure it’s safe. Others on the set shared that responsiblity, and failed too. Baldwin is morally guilty. He and others on the set need to pay a criminal and/or civil penalty.

I was hoping that police officers would come to Potter’s defense, like what happened with the truck driver in Colorado, whose cohorts came to his defense over his 110 year sentence.

I don’t think ANY thinking citizen wants an officer on the force that gets so excited and probably scared that she pulls a gun and kills the guy she was trying to help arrest.

And, oh never mind that this sob, from all accounts, deserved and needed killing.

I think the only question should be her punishment. Isolating on just Potter, perhaps she shouldn’t get much if any jail time. But, that sends a counter-intuitive message to law enforcement everywhere.

I am not yet satisfied, that is true.

Given the political opportunity that the left will likely not pass, the outcome of the “science” of how the firearm might discharge WITHOUT pulling the trigger, may depend upon the leftist’s anti-gun case and their test-marketing of their various arguments.

There may be a lot of leftwing political pressure to find the gun at fault.

And thereby, also find fault in as many individual rights and freedoms that the left “thinks” it can destroy in one blow.

Re Baldwin. Easy to find fault in his action(s). Yet, the force that causes a person to err, is far more powerful than we imagine, because that force hides itself under anxiety (depression, doubt, fear, pressures, worries), vanity, and temptations that flourish . . . and clouds the mind.

Such that, we miss the moment and direction that would have taken us away from some mess in our current path.

An example is in the Baldwin case, as much as the same in the SARS-CoV-2 / COVID-19 case:

What we do have, or what we do not have, or somewhere in between those two positions, of immunity. IMHO.
