With a criminal trial just two months away, Vicky Bratcher is remaining hopeful her husband, LaRue Bratcher, 34, will prevail in court.
“All of his three attorneys, they’ve all said this is a stand your ground,” Vicky Bratcher said of LaRue Bratcher, who has been charged with first-degree murder.
Around 1 a.m., on May 26, 2020, LaRue Bratcher was at his marijuana business, Premium Smoke, LLL, in Oklahoma City, Oklahoma, when he noticed Daniel Hardwick, 43, trying to break into his business. Vicky Bratcher says this was not the first time Hardwick attempted to break into the business.
“He was breaking in when my husband gave him his warnings and was like, ‘What are you doing?’ The man continued to break in, and that’s where my husband fired through the door. The man was unfortunately on the other side, my husband could not see what was the man’s position or anything and that’s when the bullet struck him in the head and, unfortunately, the man died,” Vicky Bratcher said.
Bratcher called police after Hardwick was shot, and when officers arrived, they learned LaRue Bratcher was operating his marijuana business without an active license, and he was arrested. Police confiscated 480 marijuana plants worth $1.5 million from Bratcher’s business.
Bratcher quickly bonded out from the lapsed license arrest, but a week later, the Oklahoma County District Attorney charged Bratcher with second-degree murder and his bond was revoked.
“I believe it was one of the prelim hearings where [D.A. David Prater] said this is not even second degree, I need to look good into this and charge you with first degree and comes back in December and charged LaRue and changed it to first-degree murder and it just made things so much harder on us,” Vicky Bratcher said.

According to the article the dead suspect hadn’t made entry, he was still on the outside of the business. There is no information that he made a threat against the shooter, or even had a weapon. It could have easily escalated if the guy had gained entry, but at the time the shot was fired I don’t see how one could claim self-defense.

Self defense requires an imminent threat of death or grievous bodily harm here in my state. It’s difficult for me to see how that applies in this case. I need more facts before I can form an opinion.

On May 27, 2020, around 1 a.m., Bratcher was at the grow operation warehouse when Daniel Hardwick, a 42-year-old white man, allegedly attempted to break into the business for the second consecutive night. Video from that night reportedly shows Hardwick park his car at the rear of the shop, walk to the business’s door and jostle with the door handle, attempting to gain entry.
“He was trying to break in when the business owner, who was inside the business at the time, apparently opened fire with a handgun, striking and killing the man who was breaking in,” Master Sgt. Gary Knight with the Oklahoma City Police Department told KFOR.
And his grow license had expired.
Bratcher called the police shortly after the shooting, and once at the scene, officers called the Oklahoma Medical Marijuana Authority to ensure the business was legal. When they found out that the business’s license had expired, Bratcher was arrested for operating a grow shop illegally, a felony, and was held on $5,000 bond. He was not, however, initially arrested in Hardwick’s death. In addition to arresting Bratcher, authorities also seized 480 marijuana plants worth an estimated $1,500,000.

depends on the state, but in some states you can’t shoot until they enter the home, and shooting through the door has gotten others in trouble with the law.
Sounds more like a drug deal gone bad.

Not attempting to notify the police until after the shooting, no license - how is that different from any other drug related crime and is certainly not self defense, since the perp was not threatening the life of the provider?

The victim WAS NOT in the building, he was on the outside. He shot through the door. The shooters life wasn’t endangered, and he was committing felony narcotic distribution, by not having a license for his plant growth, when he fired. I can’t see him not getting convicted here.
So, I'm with the "legal experts" regarding the outcome, although I believe he was justified.
I am not sure I can agree and certainly we are not privy to all the facts. There are many cases where it has been shown that to claim self defense one must have ‘clean hands’. Because he was illegally growing and distributing (a criminal activity) himself, there may be a case that he cant claim self defense. I am not making that claim, I am just saying this may find its way to grey areas of law.
The president told us we could shoot through our doors.
