The U.S. Senate has confirmed Suffolk DA Rachael Rollins as the new U.S. Attorney for Massachusetts.
Rachael Rollins’ confirmation as U.S. Attorney for Massachusetts could come with a political price as President Biden’s latest liability.
Faster than you can say “nolle prosequi,” Sen. Ted Cruz made it clear that the Suffolk district attorney would be the GOP’s Exhibit A for “left-wing prosecutors” who look the other way while criminals get off scot-free in “Joe Biden’s America.”
Vice President Kamala Harris needed to break a 50-50 tie — twice, actually — in the U.S. Senate to save Rollins, as all Republican senators stood against her confirmation.
Massachusetts Gov. Charlie Baker now has to make a politically fraught decision to replace Rollins in the Suffolk D.A.’s office. Rollins was the first Black woman elected to that office and there will be pressure on the Republican governor to avoid the usual roster of white males like Boston City Councilor Michael Flaherty to fill the void.
But there will also be pressure on Baker — who just announced his decision not to seek a third term — from the right to put a law-and-order Republican in the D.A.’s office.
For Rollins, it was the first time in nearly five decades that a U.S. Attorney had to be confirmed in a roll call vote.
Republicans, in fact, gave up opposing five other U.S. Attorney nominees the day before, allowing them to sail through without a vote.
But stubborn GOP senators would not cave in on Rollins, who has gained notoriety in conservative circles for her list of 15 different non-violent crimes she has directed her office not to prosecute.

REALITY CHECK she cannot selectively decide which laws to enforce.......the legislature alone holds sway over laws.

REALITY CHECK she cannot selectively decide which laws to enforce.......the legislature alone holds sway over laws. The laws are still on the books. They stay on the books until the legislature says otherwise.
But if the prosecutor refuses to prosecute, then the bad guys just walk out the door. The legislature can't say much about that.

Most of the time, prosecutors have the final say when it comes to filing charges .....but .......
Political or public pressure sometimes changes their minds.
Checkout the Smollett case......prosecutor dropped charges....angering the mayor and the police.
Special prosecutor Dan K. Webb, who had been investigating the case for months, helped bring the new charges in Cook County after taking over from the former state’s attorney Kim Foxx who dropped the charges against Smollett.
Her controversial decision shocked many and led to an unprecedented press conference by the Chicago Police Department in which it blasted the decision.
Webb said that he’s pursuing the case against Smollett because “reasonable grounds exist to further prosecute the actor.”
Once it became clear that Smollett was himself a suspect, Ms. Foxx recused herself from the case, but her actions had already embittered the police department, and the head of the police union accused her of interference.

1. Trespassing
2. Shoplifting (including offenses that are essentially shoplifting but charged as larceny)
3. Larceny under $250
4. Disorderly conduct
5. Disturbing the peace
6. Receiving stolen property
7. Minor driving offenses, including operating with a suspend or revoked license
8. Breaking and entering — where it is into a vacant property or where it is for the purpose of sleeping or seeking refuge from the cold and there is no actual damage to property
9. Wanton or malicious destruction of property
10. Threats – excluding domestic violence
11. Minor in possession of alcohol
12. Drug possession
13. Drug possession with intent to distribute
14. A stand alone resisting arrest charge, i.e. cases where a person is charged with resisting arrest and that is the only charge
15. A resisting arrest charge combined with only charges that all fall under the list of charges to decline to prosecute, e.g. resisting arrest charge combined only with a trespassing charge
Instead of prosecuting, these cases should be (1) outright dismissed prior to arraignment or (2) where appropriate, diverted and treated as a civil infraction for which community service is satisfactory, restitution is satisfactory or engagement with appropriate community-based no-cost programming, job training or schooling is satisfactory. In the exceptional circumstances where prosecution of one of these charges is warranted, the line DA must first seek permission from his or her supervisor. If necessary, arraignment will be continued to allow for consultation with supervisor. Thus, there will be an avenue for prosecuting these misdemeanors when necessary but it will be appropriately overseen by experienced prosecutors.

I always throw up a little in my mouth when some one talks about “spending political capital” or “paying a political price” or some such. It’s utter nonsense. Biden and his accomplices ram another bit of tyranny down our throats and they suffer exactly ZERO consequences for it. There is no such thing as “political capital”. When leftists do something unpopular it does not in the least diminish their ability keep doing the same thing.
