The Sixth Circuit Court has denied the federal government’s motions to transfer the Occupational Safety and Health Administration (OSHA) vaccine mandate lawsuit to Washington, D.C. and hold it in abeyance, dealing another blow to the Biden regime that has banked on the relatively small agency’s ability to enforce its divisive mandate.
In the court documents, posted to Twitter by populist pundit Election Wizard, the Court denied the government’s motion to transfer the case to Washington, D.C., denying the government’s request to hold the case in abeyance.
The Court also granted two unions, the International Electrotechnical Commission and the IEC Florida West Coast Chapter, permission to join the lawsuit.
“NEW: Sixth Circuit denies government’s motions to transfer and to hold the #OSHA vaccine mandate case in abeyance,” wrote Election Wizard. “Translation: The government wanted to transfer the case to a possibly more favorable court (Washington D.C.). OSHA also tried to slow-walk it. The court said no.”

The government didn't respect the outcome of the lottery that awarded the case to the Sixth Circuit?
The government was always planning to try to move the case to DC regardless of how the lottery turned out?
Is the government done trying to get the case moved to DC, or will it eventually find its way there?

Maybe a lawyer FReeper can weigh in here, but I think this is the last gasp for the left to get the case transferred to a bought and paid for friendly federal jurisdiction. It would have to be appealed to the USSC and I don't think the court will grant a motion to move the case.
Venue is not grounds for appeal before the case is decided (”interlocutory” is the three dollar word for appeals taken before the case is decided)
There two OHSA paths. An Emergency Temporary Standard (ETS) path, and a Final Standard path. OSHA is working on both paths, in parallel.
The ETS path is ripe for lawsuit, and here we are. The final rule path won’t be ripe until early next year (after the time for public comment has expired), and then there will be another round of litigation, this time starting in federal District Courts.
