The Claim
While making his closing statement, Assistant District Attorney Thomas Binger produced the weapon that Rittenhouse used during the shooting incident on August 25, 2020.
Binger then raised and pointed the weapon in the courtroom. The moment was captured by the court's cameras and multiple photographers in the room.
The video and images of the episode have since been widely shared online, accompanied by questions around Binger's handling of the firearm—including his appearing to put his finger on the trigger—and claims that he aimed the rifle at the jury.....
While it is accurate to say that the prosecutor raises the weapon and points it in a certain direction, the line of sight appears to go diagonally across the room, rather than toward the jury, which is seated behind and to the left of the spot where he stands.....
Finally, there is no basis to the claims that the weapon was loaded or unsafe. Both Binger and—later—defense attorney Mark Richards stated that it was first checked by a weapons safety professional.

Not mentioned is there was a photographer there Binger was POSING FOR. The entire thing was a photo op - this a couple weeks after we saw on a movie set a ‘safe gun’ kill one person and wound a second.

Even if Binger did not point it at anyone in the room, he did not know who was on the other side of the walls.
This was horrible gun safety no matter what anyone says.

Its a real pity that the defense was not able to closely question senior police officials. Who gave the order and why was there no police presence to control the riot? Why couldn’t Rittenhouse find a police officer when he was being hounded and wanted to surrender? Official negligence and dereliction of duty has always been at the core of this case.
I despise this prosecutor as much as anyone, but the photo show that there is no magazine in the weapon. If the chamber was checked and then the weapon was pointed away from the jury for a demonstration, that's perfectly safe.

The Judge shoulda locked Dinger [sic] up on a weapons charge.
That said, the ADA was negligent in how he handled the firearm. After all, to err is human. We have rules upon rules so that the error cascade prevents catastrophe. Unlike what happened on the Rust shoot. (Pun intended.)
No surprise that newsweek, a failed leftist rag, defends the dangerous action of the DA but condemns Rittenhouse.
The man acted irresponsibly. If he had aimed it at me, I would have demanded he be prosecuted, and then sued him. Obviously the police would not have arrested him as they should have.

He had no business even touching that rifle as he is incompetent and untrained to handle a firearm because he didn’t even know how to safety check/clear the firearm himself.
He didn’t treat it as if it was loaded.

I think he was doing it for drama, showing the jury what it must have felt like when Rittenhouse pointed the gun at the three Kenosha heroes.
Must be something there about brandishing a weapon at a Jury.
