Oral Arguments in Second Amendment Case Show Supreme Court Justices Split

The oral arguments for the New York Rifle and Pistol Association v. Bruen were presented on November 3, 2021, to the Supreme Court of the United States.

Oral arguments do not carry much weight with the Court, generally. They allow some public interpretation of the issues the Court members are interested in. All of the arguments have already been stated in the written briefs to the Court. With those limits, the presentation to the Court and the questions asked were interesting.

The oral arguments took almost two hours. They were scheduled for 70 minutes. This showed (no surprise) this is a very important case, important to the justices and the general public, as well as to the nation. They can be listened to at this link. Three people presented arguments to the Court, although questions by the justices often resembled arguments more than mere questions. The three people presenting were:

Paul Clement presented a well-argued and professional case for Second Amendment rights outside the home. It appeared designed to gain a moderate advance in restoring Second Amendment rights. He answered questions well.

This correspondent found Clement’s use of the words “allow” and “granted” in describing fundamental Constitutional rights to be an unnecessary ceding of fundamental principles. The rights, in Natural Law Theory, are intrinsic to the existence of humans; they are not “allowed” or “granted”.

I hate RINOs more than Democrats. They are the enemy within and are traitors.

Having said that, thank God the Turtle kept Merick Garland from being on SCOTUS. That was the one good thing he did.

Given that Roberts, Gorsuch, Kavanagh and Barrett all sanctioned the 2020 Big Steal, they are at best members of Team Bush. Gorsuch is the only one who seems solidly conservative in his judicial approach, but I fear that Barrett will be just another Sandra Day O’Connor and Kavanagh another Souter. Robert’s is a total rat.

When the Supreme Court showed,last January,their lack of wisdom...and courage...by refusing to stop the theft of the Presidential election I lost all confidence in their willingness to "upset the apple cart" in any way that confirms a citizen's God given rights.

Federal judges...all of them...are lawyers. And there can be no doubt that 98% of American lawyers are Maoists or Maoist sympathizers.

I am NOT optimistic. This one means way too much to the left and I am sure Barrett and Roberts are getting “credible” threats. Both are susceptible.

But they can find an unrestricted right to abortion in the constitution.

Reminder: Oral arguments do not mean anything.

Kavanaugh looked like he was leaning one way in the gerrymandering case, went exactly the other way.

To your point (from the article: “Oral arguments do not carry much weight with the Court, generally”, this simply means the justices have pretty much made up their minds long before oral arguments are presented; in many cases, I suspect, at the time the Court decides to accept the case or not.

The only Justices I have faith in Thomas and Alito and Gorsuch. Kavanaugh and Barrett do not have any backbone to protect this country. They can’t take the heat.

Deep State controls the SCOTUS.

The only way the mandate goes away is if Deep State decides to cut its losses and uses the court to save face.

If we get the republic back, every justice now on that court has to resign or be impeached.

Every justice.
