"Bannon has not committee a crime."

Yes he did, and if he gets an Dem judge, he will be in jail for a few months. He should have shown up and given a belligerent and generally unpleasant deposition. Simply refusing to show up both makes you look guilty, and makes for an easy prosecution.

2 U.S. Code § 192 - Refusal of witness to testify or produce papers

U.S. Code

Every person who having been summoned as a witness by the authority of either House of Congress to give testimony or to produce papers upon any matter under inquiry before either House, or any joint committee established by a joint or concurrent resolution of the two Houses of Congress, or any committee of either House of Congress, willfully makes default, or who, having appeared, refuses to answer any question pertinent to the question under inquiry, shall be deemed guilty of a misdemeanor, punishable by a fine of not more than $1,000 nor less than $100 and imprisonment in a common jail for not less than one month nor more than twelve

The statute is self-contained and explanatory. Says not one word about a grand jury. This is a rail-roading.

He is guilty - of refusing to cooperate with an illegitimate government enterprise.

Rosa parks was guilty too.

So were the people running underground railraod.

I admittedly do not know the answer to this, but did not Trump claim executive privilege on the communications with Bannon as an advisor?

I thought that was the basis for his refusal to appear.

Looks unonstitutional. Where in the Constitution does Congress get the legal authority to subpoena The People?
