The U.S. is facing a serious constitutional crisis over the handling of the cases of defendants in the Jan. 6 so-called "insurrection" in Washington, D.C. to protest the presidential election modus operandi and the results. Those being held for many months without a trial are being denied their habeas corpus rights under the U.S. Constitution and even dating back to English law hundreds of years before our Constitution was implemented. Not only are they being incarcerated without having had a trial, but there is some evidence that they are being mistreated or are being held 23 hours a day in solitary confinement, which is a punishment accorded only the most dangerous criminals, such as serial killers and terrorists.
What are habeas corpus rights? According to the American Civil Liberties Union (ACLU), "[h]abeas corpus is a fundamental right in the Constitution that protects against unlawful and indefinite imprisonment. Translated from Latin it means 'show me the body.' Habeas corpus has historically been an important instrument to safeguard individual freedom against arbitrary executive power." A citizen must be charged and cannot be held indefinitely. A charge requires a trial, and, if found guilty in a trial, there is a sentence for a specific amount of time.
Even PolitiFact — hardly an unbiased fact checker — relates, "The vast majority of defendants have been released from custody while awaiting trial, but some [my italics] held in jail have been kept in solitary confinement." The fact that exact numbers for how many are held in solitary confinement or for how long suggests to this writer evasion by the Washington, D.C. jail authorities.

There are Gitmo prisoners being held for almost 20 years without being charged.

They have been charged. That part of the rant is false.
They are political prisoners being treated badly on purpose to teach the citizens a lesson. You will notice that those who sympathize with the defendants are themselves labeled dissident, terrorist sympathizer and so on. Notice that all three branches are singing this in harmony, too.

I do wonder what the practical effect of that would be. The vermin infest everything, importantly a large swath of "thought and belief." State legislatures are not immune to the same disease that has infected the US federal government. The effective subversives are the ones IN the government.
There is no rule on paper that can prevent bad people from taking control.
Not to say don;t repeal the 17th, I'm in for that move. I just wonder what effect it would have in fact. I understand the effect in principle, on paper, etc.

When the tables were turned on January 6th, the Deep State and Liberal Democrats blood turned cold. They saw and projected what they would have done with those people. They feel that they were lucky to have not been killed by the mobs. They don't understand that the only person really killed in the “armed insurrection” was one woman protester. Yes, some police officers suffered injuries and some may have even lead to death, but no politician nor any political staffer was killed. The Deep State and the Liberal Democrats have now seen a mob go after them, even if it was a mob with one arm tied behind its back.
The Liberal Democrats and Deep State know what mobs are capable of and that is why they are so afraid and why they have violating every Constitutional right of those connected with January 6th.
