Lawless: Joe Biden Tells Companies to Defy Courts on Vaccine Mandate
Townhall ^ | 11/09/2021 | Matt Vespa

President Joe Biden either doesn’t know the court ruling, or he forgot. Maybe he doesn’t remember. Maybe he just doesn’t give a damn. Either way, dementia brain has told companies to ignore the recent court ruling that hit the brakes on the vaccine mandate that liberals have been lusting for since day one. The ruling halted the mandate the required companies with 100 or more employees to be vaccinated or else. The Occupational Safety and Health Administration (OSHA), which already can’t its job properly, is now being dragooned as Biden’s medical secret police to enforce the rule. It was also known that this mandate could expand to companies with fewer than 100 employees. It’s government. It’s the Democrats—unlimited power is the end game (via CNBC):

The White House on Monday said businesses should move forward with President Joe Biden’s vaccine and testing requirements for private businesses, despite a federal appeals court ordering a temporary halt to the rules.

“People should not wait,” White House Deputy Press Secretary Karine Jean-Pierre told reporters during a briefing. “They should continue to move forward and make sure they’re getting their workplace vaccinated.”

The U.S. Court of Appeals for the 5th Circuit, considered one of the most conservative appellate courts in the country, halted the requirements Saturday pending review, writing that “the petitions give cause to believe there are grave statutory and constitutional issues with the Mandate.”

The Republican attorneys general in Texas, Louisiana, Mississippi, South Carolina and Utah, as well as several companies, requested the pause. They argued that the requirements exceed the authority of the Occupational Safety and Health Administration, which will enforce the mandates, and amount to an unconstitutional delegation of power to the executive branch by Congress.

This is a constitutional crisis. This is an insurrection. This is tyranny. These are the Left’s rules. The president is defying the courts. This is an impeachable offense. Someone should get a special counsel investigation going. This strikes at the integrity of our institutions. Rinse and repeat. Funny how the hysterics just outright vanish when a Democrat is in the White House, huh?

Everyone should do what Florida is trying to do: sever all ties with OSHA to bypass the mandate.

Is that not a crime in itself?

Sleepy Joe should just label the court ruling as "garbage," get hot under the collar, yell at the reporters, and then scold the electorate for "trying his patience."

Always works like a charm, right?

Regards,

Many Americans support this. I’m not sure liberty will come back to America in my lifetime.

They’ve created a class of lazy drones who crave government control of everything. The media will tell them:

We’ve always been at war with Eastasia.

Okay, this is just bad reporting. I realize what the Biden Administration is doing here looks like defiance of a court order, but it isn't.

The Court order says that the Biden Administration mandate is -- at least temporarily -- unenforceable. So the government mandate cannot be enforced upon businesses. However, this is nothing illegal about Biden urging businesses on their own authority to mandate the vax for their employees. Businesses ordering a mandate on their own does not defy the Court order.

The people in the Cabal running the "Biden Administration" do not care what the Courts say. The Courts have no enforcement powers.

If the "Pretense-of-Law" is inconvenient for the Cabal, they will simply drop the pretense and attempt to rule by decree.

They are doing that now. They are harming people now.

When you see the flash, be sure to brace for the shockwave.

I just really hate it when our side commits a basic factual/legal error that misleads people, because it makes us easily mocked by the other side.

I wouldn’t worry about that at the moment...

“To win one hundred victories in one hundred battles is not the acme of skill. To subdue the enemy without fighting is the acme of skill.”
— Sun Tzu

If the Democrats can get companies to enforce an unwritten and unenforcable mandate, they win. The government isn’t even “involved”. The government isn’t “waging that fight” at all. It’s just totally “out of their hands”, just like the court said.

No, it isn’t. Not if he can convince businesses to impose a mandate on their workforce on their own authority.

Does an employee who is fired at this juncture have any remedy against the employer?

So it’s a crime. There is no rule of law except not wearing a mask. The Supreme Court doesn’t care about the law. American citizens are killed every day by the hundreds of thousands of illegals pouring into our country and the courts don’t care. America is becoming Venezuela 2.0 right under our eyes. Where’s Congress?

I believe your employer can let you go at any time, for any reason. Won’t get jabbed? They can fire you and you’re stuck.

But on the other hand, if you do take the jab, and have a bad reaction, you cannot sue the vaccine maker. They have immunity, so you are stuck again.

What remains to be seen, I think, is if your employer threatens to fire you, and so you take the jab to keep your job, and have a bad reaction — can you sue your employer??

I think you could, but I’m not sure that has really been established. My belief though, if that many employers are going to be pulled into court by damaged employees.

I believe any company can mandate vaccination, even if and in spite of government exhortation.

The USSC has upheld this principle on a couple of occasions.

I don’t believe this is currently a government mandate, though the government would like it to be.

Cajoling without penalty is not illegal or unconstitutional.
