Its private employer vaccine mandate on hold, the Biden administration wants the multiple challenges to its workplace rule consolidated in a single federal court and has asked for a decision by early next week.
The U.S. Department of Justice said in court filings Monday that one of the federal circuit courts should be chosen at random on Nov. 16 to hear the cases.
At least 27 states plus several businesses and associations filed a dozen legal challenges in at least six federal appeals courts after the Occupational Safety and Health Administration released its rules last week. All the states have a Republican governor or attorney general.
Over the weekend, judges on the New Orleans-based 5th Circuit U.S. Court of Appeals paused the rule from taking effect, saying it raises “grave statutory and constitutional issues.” White House spokeswoman Karine Jean-Pierre on Monday expressed confidence that the COVID-19 vaccine mandate can withstand any legal challenges...

I suspect Biden’s team is asking for a lottery ticket, which will be a fixed drawing to make this case flow to a more left leaning district court other than the 5th circuit.
and the fact that the crooked AG is asking for it, means his team does have a plan to push things that way... (once a bully, always a bully).

I believe that taking this before the whole supreme court will be blocked with anything Joe’s team can throw at it.. because there is a substantial risk that JOEBLOW will get his politically shrinking nuts, completely cut off.

Herod in the book of Acts... a sampling of chapter 12 shows us the difficulties that God can inflict upon the Herod(s) of the world governing his people in the USA. I think a small divine intervention could help balance out the tyranny in process at this time. Here’s hoping for a obstruction to evil and a delivery of righteousness to this nation’s free people.
FWIW: Acts 12 has two great stories of such things: God protected his own (peter in prison and the early church), while smiting the tyrannical terrorist Herod down.

It's more like calling for "best two out of three" after you've already lost the coin toss.
For a variety of legal reasons, the government pretty much has to win every case. If it loses even one, a nationwide injunction could be issued, and upheld by that Circuit. And given that it looks like the Fifth Circuit isn't going to be a sympathetic ear, the feds came up with the brilliant idea of consolidating all the challenges into just one case. That way, they only have to win that won case rather than every single challenge.
Can't see the Fifth Circuit going for this. I haven't done multi-district litigation, but I'm not sure that the government itself can invoke MDL as a defendant anyway. Also not sure about whether the issuance of the injunction already locks out MDL.
Except Congress/Senate and WH and other government workers.
