After U.S. Court of Appeals Blocked the Mandate, Biden Admin Promises 'Long Fight' Over Vaccine Mandate, Which Is Exactly What It Wants

On Saturday, a three-judge panel from the U.S. Court of Appeals for the Fifth Circuit temporarily blocked Joe Biden’s COVID vaccine mandate on businesses with more than 100 employees. White House Chief of Staff Ron Klain said he’s confident that the mandate will eventually be held up and promised that the Biden administration would fight for the mandate, which was set to take effect in January.

“I’m quite confident that when this finally gets fully adjudicated, not just a temporary order, the validity of this requirement will be upheld,” Klain said on NBC’s “Meet the Press” on Sunday. “If OSHA can tell people to wear a hard hat on the job, to be careful around chemicals, it could put in place these simple measures to keep our workers safe.”

Klain may be acting confident, but, as I said in September, Biden’s mandate is a red herring that will inevitably fail to pass constitutional muster in the courts. The Biden administration most certainly knows that the vaccine mandate won’t hold up. They previously recognized their lack of authority to impose a vaccine mandate. White House Press Secretary Jen Psaki said earlier this summer that vaccine mandates are “not the role” of the federal government. “Well, I think the question here — one, that’s not the role of the federal government,” she said on July 23, offering no exception to this assessment. “That is the role that institutions, private-sector entities, and others may take. That certainly is appropriate.”

Constitutional or not, a recent Gallup poll suggests that a majority of the public supports Biden’s mandate.

That poll is utter nonsense and will become even moreso as vaxxed people start getting COVID in the Northeast this winter.

I am not a legal scholar and I don't know all the precedent out there that they claim justifies that mandates can be imposed by FedGov. But I do know this: it's certainly not the role of the President to dictate to citizens what they must do. Period. The legislature can pass laws, the President can sign them but as long as we claim to be free people then we cannot have a king. And a man who says he's lost patience with our choices so he's taking them away because he says so is governing like a king.

Maybe it could stand up if congress passed it as a law. I cannot see how the President weaponizing the bureaucracy to create his own laws on a whim can. Yet ... this isn't the first such case of doing that (FBI, IRS, EPA, they all do it) and it HAS withstood judicial review.

Are we truly still a free country? I think it's a legitimate question.

These are not comparable at all. But he honestly believes businesses and workers, and worse the courts, will fall for this logic. His logic is along the lines of:

Regarding the requirement that even Federal contractor employees who work remote be vaccinated: If OSHA can require workers and other onsite personnel to wear a hard hat on a multistory building’s construction site they can require the same of Walmart greeters.

Regarding his remark about chemicals. If OSHA can require full protective gear for those working with hazardous chemicals we can require it of all janitorial service workers.

One thing that can’t be shown is OSHA needing to implement this via an emergency order.

Yup—the failure of the vaxxes plus some nasty side effects are gonna teach some gullible people that they were scammed by the vaxx-pushers.

Then the grieving process will begin for the vaxx victims—the Five Stages:

1. Denial
2. Anger—this is gonna get ugly, and the vaxx pushers will not see it coming.
3. Bargaining—not sure what this will look like...
4. Depression—this will not be fun—especially for folks with serious side effects.

Alot of the employers were asking for the jabs before the mandate happened. It’s sad to say this but alot of employers welcome this mandate.

I was seeing job ads requiring the jabs in early summer.

Taking the jab is playing Russian Roulette..90-95% chance you won’t get an adverse effect or even death.

How many other agencies could do this? I think a few - I don;t mean legitimately, I mean as a way to keep pushing, even if nonsensical. IRS needs healthy taxpayers, make “I’ve been vaxed” one of the items on return.

And as that winds down, gear up legislation. Require states to mandate as a condition of handouts would be pretty effective. Worked for 21 y/o drinking age and 55 MPH speed limit. state take mney from hundreds of federal buckets. Put the mandate in every one of those.

Nuremberg trials was military tribunal by a conquering army. before that, all was legal. What in place here is there is no country willing to prosecuute another, and of course no country will prosecute itself.
