City's Attempt To Cut Texas Man's Grass Leads To A Standoff, A Fire And His Death

An attempt by Austin, Texas, officials to serve a search warrant and provide lawn care resulted in shots fired, an hourslong standoff, a house fire and a death, police said Wednesday.

Police officers and code enforcement officers arrived at a home at 9:16 a.m. to serve a nuisance search warrant, but could not make contact with the resident, Austin Police Chief Joseph Chacon said at an evening news conference.

The warrant was left at the door and contractors for the city's code enforcement began working on the lawn. About an hour later, the resident started shooting from inside the house, Chacon said.

"And they immediately backed off. They got all of the staff that was working on the house to safety and and a SWAT call was initiated for a barricaded subject," he said.

SWAT, mental health officers and a crisis negotiator arrived on scene, but could not get the man out of the home, leading to the lockdown of a nearby elementary school and the closure of several streets.

"SWAT spent the next several hours trying to negotiate with the individual to just simply come out of the house," Chacon said.

At about 3 p.m., the resident started shooting at officers again. "And because of that immediate threat ... they made entry using a robot," Chacon said.

The robot helped officers determine that a fire had been started in the home, and was quickly spreading, he said. Officers still couldn't get the man to come out of the house as it became fully engulfed in flames.

But then the man exited through the garage with weapons in his hand. "At that time, a SWAT officer shot and struck the resident who went down with a gunshot wound," Chacon said.

Their main goal Wednesday was to get the man in compliance with the local homeowners association.

are they serious? they city has no authority to enforce homeowners association rules, possibly city code but not hoa rules. crazy lets see the rest of the story.

I side with the dead guy.

There are cities all around this country where people openly defecate, urinate, vomit, have sex of all kinds, sell and use drugs in the open for everyone to see.

It isn’t even their residence, they have no right to be there. They are just homeless (worthless) squatters.

Nobody (from the government) shoots them!

I don't understand the, "we need to get him out" mentality.

Just leave him alone.

He has to come out eventually or the problem will just work it's self out naturally.

Sometimes not doing something is the correct option.

Some folks are wound real tight nowadays, and many folks are suffering from lots punitive government overreach caused stress and anger, in fact this has caused many people to become shut ins and anti social. This is certainly no secret. I would guess instead of throwing a warrant down, leaving it on his porch, while teams of strange people proceed to enter the mans property, doing as they please.. They very likely could have done this very differently.

It's odd how we coddle, subsidize and make excuses for millions of criminals entering our country illegally, at will, yet citizens are treated like this?

In fact, I'd bet the "authorities" were fully aware of this man's demeanor and or mental state, yet they just kept poking the bear, a bear who likly just wanted to be left alone.

Comply or Die is the policy.

It does not matter what the order from the Government may be. If you refuse a Government order, and escalate that refusal vigorously enough, the agents of the Government will eventually resort to lethal force.

Government is a dangerous power tool. It matters very much who is running it.

It doesn’t matter how much is earmarked for assisting the mentally ill. It will not be substantive or helpful. It will be grifted off to pay the salaries of the Karens running various agencies or charities, hire more staff and get new offices and furniture. The rules won’t change.

So they will still keep SWATting the mentally ill.

Oh, he probably knew it too. Sad that it comes to this, but this somehow rings similar to the lady who was found dead (suicided) in her car after many years.

Except he probably decided to just kick back and watch netflix until the money ran out, or ...

Also with the idea that if someone joins a home owners association they can never leave. Sort of like communism, you have to shoot your way out.

In the VAST majority of cases, you are told that the home you are buying is part of an HOA before closing. At closing, you are presented with the official docs of the HOA. It is damn near impossible to impose an HOA after a community is built. I believe - at least in New Mexico - that it requires 80% of the residents to agree in a physical meeting.

And with the idea that if you choose not to join a home owners association they can blatantly forge papers saying you joined.

Again, they are papers that you are presented with at closing and you have to sign off that you accept them. Should you not be so informed, and you find out after closing that there is an HOA, the title company is financially liable. You can either have them pay your dues, forever, or they must purchase your house back from you.

And if you do not do as ordered they can take your home and sell it.

Kinda, sorta. If you do not follow the rules you agreed to when you purchased your home, they can fine you until you are in compliance. At a certain point - should the fines remain unpaid - the board will place a lien on the property for the amount due. Our HOA recently collected over $12K in fines from a lien after the house was sold. In this case, a title company that did not do their due diligence ended up paying the $12K because they did not inform the new owners of the lien.
