The Department of Homeland Security issued a memorandum that will stop “mass” Immigration and Customs Enforcement raids of undocumented workers at job sites and instead target employers, the agency announced Tuesday.
The Department of Homeland Security (DHS) plans to prosecute “employers who exploit the vulnerability of undocumented workers,” DHS Secretay Alejandro Mayorkas said in the memorandum. He added that the raids negatively impact workers who may already be subjected to low wages and unsafe working conditions.
“The deployment of mass worksite operations, sometimes resulting in the simultaneous arrest of hundreds of workers, was not focused on the most pernicious aspect of our country’s unauthorized employment challenge: exploitative employers,” the agency said in a statement.
“These highly visible operations misallocated enforcement resources while chilling, and even serving as a tool of retaliation for, worker cooperation in workplace standards investigations,” the agency added.
“Exploitative” employers may also negatively impact law-abiding American workers and businesses because they pay undocumented workers substantially less, in turn creating an unfair labor market, according to the DHS.
DHS officials were directed to stop all “mass worksite operations” and refocus enforcement actions against “unscrupulous employers,” Mayorkas said. The agency will adopt policies more conducive to diminishing the demand for illegal workers and worsening consequences for employers who hire undocumented workers.
The directive includes a policy review order directed toward making it easier for illegal workers to report their employers’ abusive practices to the federal government, according to the DHS.

Employers should have aways been the target. But they have to be fined with an amount way more than just the “cost of doing busi ness”.
Nonsense. Stop them at the border, it precludes their illegal employment. These laws concerning both aspects have been on the books for a long time, they have just not been enforced. Now you are telling me this demented bastard without a brain is the brains behind this? NONSENSE!

If the govt. doesn't want employers hiring illegals, then the govt. should make sure there are no illegals available. Also, cut the welfare payment which makes it more lucrative to be on the dole than to work.

How about those companies who employ illegals through the business tax ID game? Subcontractors is the way many do it. Just issue a 1099 to the business the illegal creates. Then it’s all legal!
There is L & I regulations regarding treatment and pay of ag workers here in WA.
Those are very stringent, plus the worker have cell phones and they have that number on speed dial.
In an industry where the product is highly perishable, it is very hard to pull what you say you have seen. The workers are free to walk away regardless of their legal status.
That brings up the legality of the situation. By law employers are required to accept 3 pieces of identification based upon their appearance. That was the requirement. At that time there was a flourishing industry of producing fake cards that were indistinguishable from real cards.
That is why most growers, who are of size, use the H2A program even though it is more expensive. But, that has its own ramifications which I can't go into right now.
I think your ag
experience with Washington State regs, limits your understanding of many other states and industries, e.g. construction, hospitality, health care and H1b visas.
The H2A program is Federal. There is a prescribed wage that the employers are required to pay those workers as well as their are guaranteed a certain numbers of paid hours per week, regardless of whether they perform any work.
The workers are vetted in Mexico, in this case, and they are vetted on this side of the border.
They are provided transportation on the Mexican side as well as transportation to their place of employment. They are provide housing. They pay for their food, either at their housing, if available, or they buy it at grocery stores.
The wage they are paid is called, adverse wage determined by the program, which is generally higher than that paid local workers. But, once these workers are on the job, then all the workers are paid that wage. And the regulations are extensive, these are just a few.
That is ALL DOUBLE SPEAK:

I am a life long accounting person. The last time I did payroll information for a roofing client was 1992. AT THAT TIME-—Workmen’s Comp insurance rates were 105% of the gross payroll earnings.
IF you paid a gross check to a working roofer of $1000 -—you will pay a workmen’s comp premium of $1050.00....SOOOOOO—those people get paid CASH.
THAT is ONE reason many construction companies are using illegals.
I totally fail to see why ‘going to the companies’ will produce accurate results versus going to construction sites.
There are NO records at the office....CASH is handed out.
Why in the hell is that program not made available to American CITIZENS first?
