IBM Requiring Workers to be Vaccinated by Dec. 8 or no Pay

Technology icon IBM has informed its U.S. workers that they must receive Covid vaccinations by Dec. 8, or they will suffer an unpaid suspension.

It's about obeying President Joe Biden's vaccine requirement for government contractors. "As a federal contractor, it is a business imperative for IBM to comply with this mandate," IBM said in a memo distributed to employees this week and cited by CNBC.

"In light of this requirement, the policies of many of our clients and partners, and the easy access to vaccines around the country, we will now require all IBM U.S. employees to be fully vaccinated by December 8, 2021, in order to work at IBM."

But IBM scofflaws get off easy compared to some other companies, including several airlines, where unvaccinated staffers will get the boot.

At IBM, non-vaccinated employees won't get paid after Dec. 8 until they get the shot or shots, depending on which vaccine regimen they follow.

What's the legal angle here. I'm sure this was route was taken at the behest of their lawyers to protect the company.

Scofflaw; noun; One who habitually violates laws, especially laws that do not involve serious criminal offenses.

No bias in reporting here.

there is no actual MANDATE.

this is genocide, and IBM LOVES it because
the upper levels will not take the poison,
and the others
.... will die (no more messy pensions for them)
leaving more money for the 7th floor.

I don’t think you can file for unemployment if you’re suspended without pay. Nasty bullies at IBM ... and a lot of other companies who love America ... for making a profit ... not so much for liberty and all that “esoteric” stuff that gets in the way of making a profit.

Suspended without pay means still employed. Which means no unemployment benefits and no severance package. And it also probably means a lot less paperwork if the person gets the vaccine, reinstating not rehiring.

system breaks, the suspended employee gets called “ this thing is broke, we need you to fix it!!”

Employee says: “Go F**k yourself I am suspended without pay “

Employee gets fired for insubordination and receives no unemployment benefits.

Trying to make them quit, or possibly generate "cause".

If I were to guess, their lawyers aren't so confident that the action of firing those who refuse the vaccine will be immune from further legal jeopardy.

IBM has been in financial trouble for years. This is about stock manipulation. They want to affect a layoff but don't want it to affect their stock price. They already spun off their managed services under a new name of Kyndryl.

The SEC and Department of Labor need to call them on the carpet.
