Black woman in rural Texas struggles with process to vote, advocates say system is unfair

While voters across Texas submitted voter registration applications on Monday, Oct. 4, ahead of the Nov. 2 statewide election, 82-year-old Elmira Hicks worried she would not be able to have her vote counted.

The Oakwood, Texas, native said she hasn't been able to renew her driver’s license for more than a year because she has been unable to present the required birth certificate needed to verify her identity.

In the Lone Star State, election laws require voters to present a driver's license, passport, military identification card, citizenship certificate, state election identification certificate or a personal identification card to cast a ballot in person.

A person does not need an ID to register to vote, or to vote by mail in the state of Texas.

I think somebody told you needed your birth certificate to get a real ID when you renew your license. Not necessary if you don’t want a real ID the only reason for that is so one can get on an airplane.

If a voter does not possess or cannot reasonably obtain one of the seven acceptable forms of photo ID, the voter may file a Reasonable Impediment Declaration and present a supporting form of ID, such as a bank statement, current utility bill, paycheck or government check.

For voters ages 70 and over, an otherwise valid form of ID may be presented when casting a ballot, even if it’s expired

Her expired driver's license is a valid ID in Texas, because she is over 70.

She could also present a utility bill, bank statement, or government check.

How could she not have one of these?

Getting a copy of your birth certificate from the Govt is an easy on line process.

Because she is over 70, her expired driver’s license can be used as a valid voter id.

She doesn’t have to do anything. She already has an acceptable voter id—her EXPIRED driver’s license.

I kinda don’t care. Need real ID to travel, drive, probably bank in the upcoming digital currency world. I don’t care lady. Get a real ID like everyone else.

Texas finally started implementing Real-ID on the drivers licenses, so when I renewed mine last year I had to provide my birth certificate. I had been renewing it without that for years until the new requirements came about.

If born without a BC of live birth, it is acceptable to present witness affidavits, family bibles, etc to establish proof of live birth to the state. The testimonies of the members of your local church will go a long way as well.

There are workarounds that have been used for over a hundred years to solve this issue. I am also sure SS, Medicare, welfare documents would also support establishing the proof needed to allow the state to create a Certificate of live Birth for this person.

No story here....

You’ve heard of a half truth? This is a 10% truth...a lie.

This is a hit piece on the Texas voting system that they changed to create integrity to the system, opposite the efforts of the socialists and their mail in ballot ponzi.

Here is a list of the acceptable forms of photo ID:

Texas Driver License issued by the Texas Department of Public Safety (DPS)
Texas Election Identification Certificate issued by DPS
Texas Personal Identification Card issued by DPS
Texas Handgun License issued by DPS
United States Military Identification Card containing the person’s photograph
United States Citizenship Certificate containing the person’s photograph
United States Passport (book or card)

Here is a list of the supporting forms of ID that can be presented if the voter does not possess one of the forms of acceptable photo ID and cannot reasonably obtain one:

a copy or original of a government document that shows the voter’s name and an address, including the voter’s voter registration certificate;
copy of or original current utility bill;
copy of or original bank statement;
copy of or original government check;
copy of or original paycheck; or
copy of or original of (a) a certified domestic (from a U.S. state or territory) birth certificate or (b) a document confirming birth admissible in a court of law which establishes the voter’s identity (which may include a foreign birth document).

Unless she is independently wealthy, I’m sure if she has no photo ID, she could supply a letter or certification of her welfare, social security, or medicare association, at least. I have never heard of a person in this country that couldn’t have one of the above documents for use. So this article is a scam to attack the Texas change to the voting laws which the feds have no control over.

This is some BS right here. Every possible accommodation has been made for people in this woman's situation yet they still whine. According to her, she should just show up and be able to vote. She's nothing more than a fraud enabler and should be called such.

My MIL, 87, does not have a birth certificate (born at home and apparently not registered in the county). Despite being a Navy vet appointed by Eisenhower, she cannot get a REAL ID that would allow her to fly commercial. Political office holders sympathize, but won’t do anything to help.

The most likely reason that Ms. Hicks cannot renew her license is the requirements imposed by the federal government as a part of the REAL ID act. All states are now required to do an in-depth verification of identity and share that data with the federal government in order for the licenses granted by the state to be usable for air travel. So the real truth is that laws passed by Democrats in Washington DC are causing headaches for elderly women in Texas.

As ABC was forced to admit in their own article, Ms. Hicks can use her expired license to vote in Texas, so the "struggle" Ms. Hicks is having is just because she and her daughter are not familiar with the Texas voting laws.

Of course they left out the part about how Ms. Hicks is barred from airplanes, Amtrak trains, and buses due to Federal laws, and she can't open a bank account, or do many other things because of the Federal requirements for ID and gathering of information in order to renew a drivers license.

Under RealID a birth certificate is needed before a new license is issued.

I know of a Mom from Kansas, also in her 80’s, that was born at home and had never gotten a BC. Had to travel back to Kansas and present herself to get a provisional BC, and then wait for a state “investigation” before a “real” BC could be issues. Then the wait at the Texas DMV to get her Texas ID card.

There has been a real effort to lock up birth certificates ever since they started to be used for false identities and crime.

And yet the State Dept and Homeland Security just issues documents to unknown people from all over the world ...

Like many Black elders in the South, Hicks was born at a time when records weren't kept. She never had a birth certificate. Her daughter has helped her apply for one. The pair even went to court over the issue, and said a judge ruled in their favor. Still, they said the Office of Vital Statistics rejected Hicks because she filled out an outdated form, according to White.

Well, records were being kept 80 years ago, even in Texas; this is the 1940's we're talking about here. That said, record keeping may well have been sloppy in some rural areas, and I can readily believe that a poor rural kid born out in a remote area and not in a hospital might slip through the cracks. I can also readily believe that old paper records might have gone missing or been destroyed. But she's had all of a long lifetime to visit the country clerks office and file the appropriate paperwork to fix a gap in her vital records. Are we to believe that she's made it to her 80's without ever once doing anything that required a birth certificate? Maybe so, but that would imply an amazingly cloistered life.

But the point is this: Rather than fix scattered records anomalies in individual cases, the democrats are demanding that basic identification validation be scrapped for purposes of voting. This if of course what the democrats would want if they intended to illegally vote illegal aliens by the millions or manufacture "voters" through false registrations. Records checks do get in the way. Cui bono? remains a good reality check.

Well somebody messed up and now she has to fill out a new form. Yep, that is the biggest threat participating in our system of government by casting one’s vote that I have ever come across.

But we know that all White persons who submitted an outdated form had it approved. What do you mean we don’t know that?
