Arguments in a case challenging the validity of the 1973 Supreme Court ruling that access to abortion is a constitutional right are scheduled to take place in the nation’s highest court near the end of 2021.
The Supreme Court will hear arguments in the case of Dobbs v. Jackson Women’s Health Organization on Dec. 1, the court announced on Sept. 20.
Justices had agreed in May to hear the case, but it hadn’t been known before when the case would be heard.
Mississippi enacted a law in 2018 barring abortions after 15 weeks outside of medical emergencies or the discovery of a severe abnormality in the unborn baby.
U.S. District Judge Carlton Reeves, an Obama appointee, struck down the law, finding “it is a facially unconstitutional ban on abortions prior to viability.” A trio of 5th Circuit Court of Appeals judges later upheld the ruling.
“In an unbroken line dating to Roe v. Wade, the Supreme Court’s abortion cases have established (and affirmed, and re-affirmed) a woman’s right to choose an abortion before viability. States may regulate abortion procedures prior to viability so long as they do not impose an undue burden on the woman’s right, but they may not ban abortions,” U.S. Circuit Court Judge Patrick Higginbotham, a Reagan appointee, wrote in the decision.
That prompted a request in early 2020 for the Supreme Court to analyze the lower court decisions.
In a brief to the court over the summer, Mississippi Attorney General Lynn Fitch, a Republican, said the court should overturn Roe v. Wade.

Roberts is, without a doubt, in the “save Roe” camp.
Thomas and Alito are solid, obviously. I feel good about Gorsuch as he’s not afraid to rock the boat and be controversial.
This comes down to Kav and Barrett. Barrett might be okay. She’s a timid mouse, but she might get her courage up for this one.
Sadly, I have no faith at all in Kav to do the right thing and end this garbage precedent once and for all. He’s an establishment guy through and through and he wants to be liked at the Yale Club.
The most likely result is, in my opinion, that the “right to abortion” isn’t absolute (=may be limited by the states), but Roe v. Wade won’t be explicitly overturned. Thomas, Alito and Gorsuch will want to overturn Roe v. Wade because it has no basis in the Constitution. I am not sure about Barrett. She may or may not join them. Kavanaugh will be the swing vote.

With ROE they’re assured to have at least 4 votes to keep as is.
Which means the others have to have the convictions of Job, or better yet Trump,

So, Folks, like they betrayed Trump, they will do it again. Any grade school debater can make the argument, that a woman or man doesn’t have the God given right to abortion, that it’s a matter for the people to decide in each state.
But these gutless wonders, will back down.

I agree. It will be upheld in a vote 6 to 3. Barrett, Alito and Thomas will br emphatic,
the others will say it’s accepted law.
At the very least, they might let the states determine the parameters, but they will not overturn it.
OTOH, with Trump in the WH, it would be overturned maybe even 6 to 3.
Trump had everyone’s backs. Nobody had his.
