Portland protests: Slain Trump supporter Aaron Danielson’s estate files $13M lawsuit against city, mayor, DA

The estate of Aaron "Jay" Danielson, a 39-year-old supporter of former President Donald Trump who was fatally shot by an Antifa backer in Portland, Oregon, last year, filed a $13 million federal lawsuit Friday against the city, its mayor and the county district attorney, according to a report.

A lawyer for the estate claims Danielson’s death was "preventable" and the filing blames the city’s and mayor’s "hands off" policing strategy regarding political protests for sparking a "culture of vigilante policing" ....

...On Wednesday, at a Portland City Council meeting, Portland Mayor Ted Wheeler backtracked from supporting "hands off" policing after previously expressing support for it, citing the response to a more recent clash in the city, on Aug. 22 of this year.

"It is clear, based on the public outcry, on the media outcry, on the national front, that that strategy was not the right strategy," Wheeler said during a Portland City Council meeting, according to The Associated Press....

This sort of thing should be happening all across the country - but I thought these government jerk-weeds were protected by sovereign immunity. Don’t know if that’s actually the case, but sure hope it isn’t.

If a LEO had pulled the trigger they would definelty have a case. But this lawsuit seems to have no basis in law, for municipalities typically have no legal duty (such as would be grounds for civil liability to this kind of plaintiff) to enforce the law.

Sovereign immunity does not apply to federal civil rights claims against municipalities under Section 1983. In practice, the municipality and the culpable local public officials get named as defendants in such actions for damages and can be collected against. Moreover, although states cannot be sued directly in federal court for damages, in aggravated cases, damages for civil rights violations can sometimes be gotten against culpable state officials under Section 1983, with the states then paying the damages settlement or award.

The essence of the civil rights claims in the Portland cases and other similar ones involving Antifa and BLM stems from the officials and the municipality failing to protect those demonstrating against or otherwise expressing or being in opposition to those organizations. The constitutional principle of law involved was prominently applied in the South in cases involving local officials cooperating with or turning a blind eye to the Klan's depredations against Blacks and civil rights demonstrators.

Unfortunately, the field of civil rights law is complex and specialized, with far too few conservative civil rights plaintiffs' practitioners. The result is that Lefty police and public officials often feel a sense of de facto impunity in letting Antifa and BLM beat up on their conservative opponents. In truth, today's Leftists in public office are worse than Bull Conner and other malignant racist officials in the South in that today's Leftists know better but do not care about the law.

About the killer:Michael Reinoehl was a “professional snowboarder.” Wife was divorcing him. “antifascist supporter.”

Reinoehl was wanted for failing to appear in court for a June 2020 speed racing case. He had raced his 17-year-old son on Interstate 84 at up to 111 mph, with his 11-year-old daughter as a passenger in his car. The car also contained marijuana, pills, and a loaded Glock pistol, for which Reinoehl did not have a license. Reinoehl was arrested for driving under the influence, reckless endangerment of a person and unlawful possession of a firearm. Reinoehl was arrested again in Portland on July 5 for having a loaded gun in public.

On August 7, according to police investigators, Reinoehl sent a text message to his teenage son saying, “Sell me the gun for a quarter pound of weed and $100 I’m getting tired of this shit I need a piece now.” Reinoehl was set to be evicted on August 29th after his landlord “apparently noticed six or seven high schoolers smoking marijuana in Reinoehl’s apartment.”

Ben correctly states the law. A federal civil rights suit might have a slightly better chance but it’s still very doubtful.

That was my first thought. It will go nowhere, although I wish it were different.

It occurred to me that if governing bodies could be held to account by lawsuit for enforcement of the laws they pass, they would pass a hell of a lot less laws.
