Governor Newsom’s Policies Promote Prison Rape

In 2003 then President George W. Bush signed into federal law the Prison Rape Elimination Act, i.e., PREA, passed by the US Congress with unanimous bi-partisan support.

This federal law has been widely seen as a big advance forward in protecting the human rights and dignity of those who, despite their criminal violations of law and subsequent incarcerations, are entitled to serve their time free of rape, sexual abuse and sexual coercion by other inmates or compromised officers and staff.

One major provision of PREA is a mandate for the US Department of Justice to "make the prevention of prison rape a top priority in each prison system.” This includes all federal, state, local and juvenile correctional and detention facilities.

Despite these advances to the field of American corrections, the State of California is now seriously backsliding and making a mockery of its duties and obligations under the Federal PREA.

In 2020 Governor Gavin Newsom signed into law SB 132, a law that allows the transfer of biological male inmates, who identify as transgendered females, to transfer into women’s state prisons to serve their sentences. This bill was spearheaded by a radical Democrat state senator from San Francisco, Scott Wiener.

Hundreds of biological male inmates identifying as transgendered females have been transferred into California women’s prisons since the law took effect on January 1. Even more are in the pipeline.

Now reports are leaking out of the state prison system that female inmates have become pregnant by these biological male inmates posing as females. In addition, many of these biological male inmates are serving sentences for state sex crime convictions.

It should be a no-brainer to all Californians that Governor Newsom, through his agents and officials at the California Department of Corrections and Rehabilitation (CDCR), is actively violating and subverting Federal PREA standards. There are also reports that CDCR officials are furtively issuing birth control to inmates in an effort to downplay the effects of this asinine state law signed by the Governor.

In the meantime, female inmates within the California system are justifiably worried and fearful as more and more of these convicted men in drag show up on their cell blocks. A female inmate compelled by prison staff to share a cell with a biological male inmate, i.e., transgendered woman, broaches 8th Amendment constitutional protections against cruel and unusual punishment.

If anything, SB 132 is most definitely unusual and even cruel to incarcerated women who just want to quietly do their time and attempt to rehabilitate themselves.

The US Department of Justice should immediately begin investigations into these cases within the CDCR. These incidents could very well rise to the level of civil rights abuses if CDCR officials are indeed acting as facilitators of prison rape, at the direction of the Governor, by biological male inmates against female inmates.

Prison rape has historically been viewed as a highly destructive criminal act that can permanently cripple an inmate’s attempt at rehabilitation. Anger, humiliation, depression, post-traumatic stress, vicious cycles of violence, and prison sex trafficking are notable reasons why the 2003 PREA was unanimously passed by both houses of Congress. A prison system saturated in sexual bargaining, coercion and rape also becomes nearly impossible to safely and securely manage from any competent prison administrator’s vantage point.

SB 132 needs to be revoked immediately. The stupid notions within this law only seem to work in theory while discussed excitedly in university faculty lounges. But in practice this law is already creating real harm. The sure to come Federal civil rights lawsuits will take time, as it may be a federal court declaring SB 132 unconstitutional. In the meantime, there seems to be no political will or interest in Sacramento to reverse this travesty of justice.

Far too many California politicians of Governor Newsom’s and Senator Wiener’s ilk see themselves on the cutting edge of progressivism. But there is nothing at all progressive about SB 132; it is regressive. Housing female inmates with male inmates, many of whom are sex offenders themselves just declaring themselves as females, if anything is simply downright medieval.

Add SB 132 to Governor Newsom’s growing laundry list of reasons to recall him from office this coming September.

Does ANYONE deserve to be assaulted when imprisoned? What about those falsely accused and convicted, do they deserve to be brutalized?

You also should know that a significant number of “guilty” pleas are because the prosecutor grossly over-charged the defendant, but the accused does not have the financial means to defend against the ridiculous charges, so they take a plea bargain.

Ending prison rape is also a good way to reduce outside rape as it de-normalizes the act, instead of perpetuating it as another way to impose one’s will on another.

Rape of ANY sort is wholly unacceptable in a civilized society, and encouraging it among a group that has no method of escaping the situation is at the least reprehensible and disgusting. Some prisoners may be the scum of the earth, but they are still human beings and their maltreatment is a stain on society.

Question: What sound do you hear from Feminists when men parading as females rape female inmates? NOTHING.

Male-on-male rape has always been a nightmare in the prison system with some female-on-female rapes happening (yes, unfortunately).

WHO PAID NEWSOME AND THE dEMOCRATS OFF FOR THE ABILITY TO BE ABLE TO RAPE THE FEMALES AT SUCH NUMBERS IN PRISON?

Yes, a bill this asinine was probably PAID FOR...........
