Local Democrats in Dallas and San Antonio defied the order not to institute mask mandates. Governor Abbott went to Court and two lower appeals courts ruled against the Governor.
It was appealed to the Texas Supreme Court, and the Texas Supreme Court just smacked down the lower courts and issued a stay.
Thus, the mask mandates are off.
By the way, the 4th and 5th Courts of Appeal are stacked with Democrats.
The media slime are all starting their gnashing of their teeth decrying that the Texas Supreme Court is “all republican” while ignoring that the 4th and 5th Courts of Appeal are all Democrat.

Thanks. This is just from the Osler McCarthy email subscription, which isn’t really intended for lay public consumption, but I wanted to get the news out for anyone who has been following.
One thing I would add is that this is all temporary and only the beginning. The underlying orders stayed by this order are TROs, which will expire tomorrow and 8/24, when the temporary injunction hearings are currently set in the respective trial courts. I expect each district judge (both Dems) to grant a TI against the governor, but the governor will appeal. That will result in automatic suspension of the TI. The courts of appeals may (and probably will, because they are both majority Dem) grant the counties temporary relief reinstating the TIs under Rule 29.3 of the Texas Rules of Appellate Procedure. The governor will petition the Texas Supreme Court for mandamus from those orders, which the Supreme Court will probably grant.

Only for the cities of San Antonio and Dallas. Not for Bear and Dallas Counties, which cover about 95% of the same populations. Those hearings are tomorrow.
Isn’t it cute how the counties and cities in Texas cooperate to have double set of orders, forcing the state to engage in lawsuit against both of them? School just a bunch of scumbag Leftists (but I repeat myself), conspiring to reduce our liberties and kill off small business.
