Amherst homeowner, town in tussle over backyard wetlands

For town officials, though, Harwood’s extensive alterations to the landscape behind his Pondview Drive home, including hardening stream banks with stones, removing vegetation along the riverfront and filling in wetlands, is a violation of both the Massachusetts Wetlands Act and the town’s wetlands bylaw.

Harwood has been warned that, without bringing his property into compliance, he could be subject, under state law, to a fine of $25,000 and a prison sentence of up to two years, a potential infraction that has prompted him to create a change.org petition calling for residents to rally on his behalf.

This guy is the typical lefty, loves big government posts on facebook on how the 2nd amendment should be abolished, votes for all democrat politicians - and now is reaping what he has sowed.

I hope the amherst conservation commissions puts the screws to him and levies enough fines and jail time that he goes bankrupt - you reap what you sow loser.

You only THINK you own property. You don’t. The government has seized ownership from you. Same principle for the “moratorium” on evictions.

You get to pay the mortgage, taxes, upkeep, insurance and expenses, but it isn’t YOUR property.

Long term goal: total confiscation of private property by the state.

There’s an accepted body of knowledge on dealing with water courses. From the description he isn’t using any part of it.

If he had what he did would have been defensible as currently accepted best practice.

He’s screwed.

Correct. This is Amherst, Massachusetts. I also thought at first that it was a story from Amherst, New Hampshire, especially with the title of the paper having the word "Hampshire"in it. And yes, "Live Free or Die" is the motto of New Hampshire.

When we moved out deep into the woods the locals said there was only one thing we needed to know—”don’t f&^% with the conservation commission”....

Here is the quote on his facebook page:

“You can shove your 2nd amendment up your ass and pull the trigger”.

2nd amendment exists as an ultimate backstop to an overreaching government, guy opposes second amendment, gets screwed by an overreaching government....karma.

(Not that in this case do I think guns should be used to resolve this dispute, but the irony is awesome).

.......as a developer of 40+ years who has spent hundreds of thousands in engineering fees and legal fees fighting environmentalists and complying with government regulations on waterways, not to mention 3 jury trials (won all 3), I both have sympathy for the guy and at the same time I’m roflmao!

I’m roflmao because I would bet the farm he’s a democrat and he votes for Liberals every time. So, TS buddy! No donation from this guy.

From my perspective, the irony in this case is that even libertarian-leaning people like me consider the regulation of rivers and streams to be one of the few legitimate functions of government.

Removing waterside vegetation and hardening riverbanks can have devastating impacts on downstream properties.

You heard what Senator Kennedy (LA) said, right? Speaking to Hannity a couple of weeks ago about the border crisis or mandatory vaccines - I’ve forgotten which... but it was:

regulation of rivers and streams to be one of the few legitimate functions of government.

The guy is a classic leftist sociopath--wants royal privileges, neighbors who submit to his every whim.

Context is relevant, and the regulators tend to treat all rivers and streams as though they are of equal importance, which of course they are not--but in general I agree with your point.

He is - read his facebook page where he trashes 2nd amendment, republicans and just about everything you expect - so no sympathy for me either.

My wife grew up in Amherst and knows both of these guys from high school. Yes, Kim would be a big Democrat. Surprised he didn’t know about wetlands preservation rules!

Amherst and Northampton are both in Hampshire County, Mass. So that’s why the local paper has that name.
