Trump STARTED the eviction moratorium BS.
I like a lot about Trump, but *hated him for this.
Evictions of deadbeat renters and mortgage holders is none of their damn business.
The CDC is not a legislative body. It’s not the Executive
Branch. It is not a court.
It has no business whatsoever addressing this issue.
The CDC started out as a malaria eradication company for a federal program that covered primarily US southern states, hence its headquarters in Atlanta.
The CDC is presently a vaccine company, owning about 20 patents on vaccines. It is a federal corporation. It does not conduct scientific research. If you “follow the science,” the trail will not lead back to the CDC.
The CDC has no lawful jurisdiction to issue edicts, moratoria, executive orders or rules and regulations that Americans are compelled to obey.
They don’t.
Hair processing, menthol cigarettes, crack and Malt liquor?
Thanks to Kavanaugh, this has to go through the federal court system again.
Likely much faster this time.
And half of governors will ignore it.
A judge will issue an injunction within a week.

Let’s take this to its logical conclusion. If the govt can stop people from being evicted due to Covid then let’s all stop paying our taxes since if the govt would allow and force landlords to forgo rent payments and NOTHING happen to the renters then we should be allowed to not pay our taxes (rent) and the govt (landlords) couldn’t do anything to us

A number (and perhaps a large number) of these UNEVICTABLES who have not been paying rent and will continue to not pay rent are PERFECTLY CAPABLE of paying rent. It’s a free ride for them with NO POSSIBLE LEGAL ADVERSE CONSEQUENCES for them.
When evictions become allowed again they will simply move and NEVER PAY BACK RENT. This is all part of the DemocRATS’ “Destroy the Kulaks” agenda.
The owners, of course, will still be required to pay taxes and upkeep on the house.
They don’t. Repubs are too cowardly to stop it.

Nope.
SCOTUS did not rule that way.
SCOTUS ruled that they WOULD NOT OVERTURN the ban in place.
In his CONCURRING opinion Kavanaugh stated a rule against was unnecessary as it was set to expire in July 31st. Then he cautioned that it would require an act of congress beyond that to violate the 4th and 5th amendment prohibitions against taking without just compensation.
But his VOTE on the case was to preserve the CDC authority.
What in the hell was the purpose of HUGE EXTRA amounts of unemployment from the Feds if not for paying rent???
Out of control government is out of control.
The left only cares about the law when it suits them. Just a another tool to use when convenient and ignore when it is convenient too.

I suspect you are right.
The standard for an injunction is simple:
1. Whether the plaintiff is likely to succeed on the merits. (SCOTUS already let the cat out of the bag here.)
2. Whether the plaintiff is likely to suffer irreparable harm without the injunction. (The irreparable harm is ongoing due to the lost rent and inability to use the property.)
3. Whether the balance of equities and hardships is in the plaintiff’s favor. (This factor also favors the landlords, as the tenants are freeloading.)
4. Whether an injunction is in the public interest. (Again, the case law is pretty clear here. Several courts have already ruled that it was.)
Not to mention that the CDC simply doesn’t have the authority to act in this area.
Taking what SCOTUS has already written on this, there are 5 votes outlining that the CDC exceeded its authority. Lower courts have already found the same.
Issuing an injunction here is an easy call. It is just a matter of when and how quickly.
