Federal judge declares DACA program illegal, but halts only new applications

WASHINGTON — A federal judge in Texas on Friday declared illegal the federal program that has allowed nearly 800,000 young people brought to the U.S. illegally as children avoid deportation and remain in the country.

U.S. District Court Judge Andrew Hanen in Brownsville, Texas, said the Obama administration failed to follow federal administrative rules in launching the Deferred Action for Childhood Arrivals program in 2012. But he put the effect of most of his ruling on hold while the case is appealed.

unfortunately, it is not dead. President Trump rescinded the exec order from Obama that created Daca and a friggin liberal judge blocked President Trump's executive order canceling DACA. This needs to go before the Supreme Court to get its final nail in the coffin. But I do not understand why it is taking so long.

Interesting that he had the bones to send it back to SCOTUS and see if there's any fresh interest in overruling Department of Homeland Security v. Regents of the University of California.

And if Big K and Little Amy both fail to turn on Roberts (who wrote Regents) and align this time with Alito/Thomas/Gorsuch to a conservative majority, then we know for sure.

I am of the opinion that DACA is not actually dead until one of two conditions occur for every single DACA “recipient”:

1) A person under DACA applies for and receives citizenship

-or-

2) They are deported

These dreamers were brought in by adults when they were at an age when they were NOT criminally libel. The administration probably would not want to discourage the adult DACA children who have now been bought and paid for through our education system and other help sources from now joining our work force. Businesses (many owned by Republicans) are screaming they can’t find enough workers.
