AUSTIN (KXAN) — A man who previously said he shot and killed a protester out of self defense in downtown Austin in July 2020 has been indicted on felony charges of murder and aggravated assault with a deadly weapon and a misdemeanor charge of deadly conduct, according to a statement from his lawyer.
The lawyer says Daniel Perry posted a $300,000 bond and has been released from custody.
Perry “will vigorously fight all of these charges,” the lawyer says. Police identified the man killed in the July 25, 2020 shooting as Garrett Foster.

Protesters surrounded the car. Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.
Former Austin Police Chief Brian Manley said that’s when the driver fired five shots from inside the vehicle, hitting Foster multiple times. Foster never fired a shot. Another protester then shot at the car three times but did not hit anyone.

I don’t know if there was a round chambered in the AK (looked to be Polish...not Russian, but not a shabby weapon) or not. The driver could not know that either, and should assume that it was loaded. I believe he acted appropriately. The fool with the AK may have just been blustering. I love the irony of him being videoed saying “F*ck around and find out.” earlier in the day. I guess it didn’t occur to him that there might be a handgun in a car in Texas.
Self defense is now illegal in democrat run cities. This is why the police are the enemy, folks. They execute the illegal orders of their democrat overlords in return for a pay check.
And the other protesters should be charged in his death.
The article says the grand jury heard/saw evidence "including more than 150 exhibits and testimonies from 22 witnesses". Rightly or wrongly, the grand jury decided that Perry should be charged. Perry chose not to testify at the grand jury probably at the advice of his attorney. The next step is for him to be tried in court by his peers.
IMHO, there is a fine line between 'disorderly conduct' and 'deadly conduct' when it comes to carrying a weapon. Let's pray that fair-minded people sit as jurors and render a verdict based on evidence AND THE LAW - and not political persuasion.
.........I think a couple things can be said about this latest Garza fiasco and they are that Austin historically is the laughing stock of State Government and the courts.
Also, I think it is highly likely that the State Legislature (perennial haters of Austin politicians) will take action of some kind to hinder or block out of state or out of country interests to donate hundreds of thousands of dollars to a marxist socialist candidate for AG.
If the jury is stacked with Leftists, they will convict the defendant regardless of facts or law. The outcome of political cases depends on juror selection and nothing else.
But even should there be an acquittal, the defendant will be impoverished with several hundred thousand dollars of legal bills. The process is the punishment.
This case should never have been brought forward. The District Attorney should not remain in office.
